Supportive Measures in Favor of Content Producers in the European Directive on Copyright in the Digital Single Market and the Approach of the New Iranian Copyright Bill to these Measures

دستورالعمل اروپايي حقوق مولف در بازار يكپارچهِ ديجيتالي مصوب سال 2019 در حال حاضر آخرين دستورالعمل اين اتحاديه در حوزه مالكيت فكري است. اين دستورالعمل از يك سو در جهت ارائه حمايت بيشتر از توليد‌كنندگان محتوا و از سوي ديگر در جهت ايجاد امكان دسترسي گسترده تر به آثار در محيط الكترونيك، طراحي و ارائه گرديده است. در اين دستورالعمل سه ساختارِ حمايت از آثار خارج از چرخه تجاري، امكان تعديل قضائي قراردادهاي بهره‌برداري و ارائه حقوق مرتبط به خبرگزاري‌ها در محيط الكترونيك قابل توجه و شناسائي است. با مطالعه تطبيقي نحوه عملكرد اين ساختارها با ضوابط لايحه جديد ايران در حقوق مالكيت ادبي و هنري، قابل استنباط است كه ارائه حمايت‌هاي مشابه در مورد آثار خارج از چرخه تجاري با بكارگيري پيشنهاداتي امكان‌پذير است و همچنين ارائه حمايت‌هاي قرارداديي به غير از تعديل قضائي قراردادها در لايحه جديد ايران براي پديدآورندگان آثار در نظر گرفته شده، اما برپايه ضوابط آن لايحه خبرگزاري‌ها داراي حقوق مرتبط نخواهند بود و اين امري است كه مي‌تواند مورد بحث و گفتگو باشد.

The new European Directive on Copyright in the Digital Single Market, approved in 2019, is designed on the one hand to provide more legal support in favor of content producers and on the other hand to offer new opportunities for consumers to access copyright-protected content. In that directive three main supportive measures can be recognized: out-of-commerce works, judicial contract adjustment mechanism and protection of press publication concerning digital uses. Through comparative study, it can be deduced that out-of-commerce works and certain contractual support, except judicial adjustment mechanism, can be provided via new Iranian Copyright Bill. However, the protection of press publication, through related rights, is not offered in the latter Bill. That is an issue which can be discussed in drafting the final version of the new Iranian Copyright Bill. .
