بررسي تغيير كاربري غير مجاز اراضي زراعي و باغ ها «از منظر فقه و حقوق موضوعه»

Checking the Unauthorized Use Arable Land and Gardens in Jurisprudence and Law

رشد جمعيت و توسعه محدوده شهرها و افزايش قيمت اراضي و بهره برداري بي رويه و غيراصولي از اراضي سبب مي شود كه اراضي كشاورزي مرغوب، همواره مورد توجه افراد سودجو و فرصت طلب قرار گيرد و با تغيير كاربري و خرد نمودن اراضي، آن ها را از چرخه توليد خارج نموده و لطمه هاي جدي را بر توليد محصولات كشاورزي وارد كنند. از اين رو حفاظت از اراضي نه فقط براي حمايت از اقتصاد كشاورزي، بلكه براي حمايت از كل اقتصاد كشور، امري ضروري است. با توجه به اهميت اراضي كشاورزي مجلس شوراي اسلامي با درك صحيح از خطرات ناشي از تغيير كاربري اراضي كشاورزي در سال 1374 قانوني را تحت عنوان «حفظ كاربري اراضي زراعي و باغ ها» به تصويب رسانيد كه اين قانون بعدها بازنگري و اصلاح گرديد. در پژوهش انجام شده سعي شده است علاوه بر نقد و تحليل قانون مزبور، به اين پرسش اساسي و مهم پاسخ داده شود كه چه راهبردها و راهكارهاي فقهي و حقوقي موثر در مقابله با تغيير كاربري غيرمجاز اراضي زراعي و باغ ها وجود دارد.

In this study, we try to critique and analysis of the law, answered to important questions what strategies and legal and effective legal in confronting unauthorized users by changing farm and orchard there.
