ملاحظات اخلاقي و حقوقي در مواجهه نوجوانان با پورنوگرافي در فضاي مجازي

Ethical and Legal Considerations in Dealing with Adolescents' Exposure to Cyber Pornography

زمينه و هدف: يكي از مهم­ترين خطرات استفاده نوجوان از اينترنت، بازديد از سايت ­هاي پورنو و هرزه ­نگاري ­هايي است كه به­ سهولت در دسترس آنان قرار مي­ گيرد. هدف اين مطالعه واكاوي ملاحظات اخلاقي و حقوقي در مقابله و جرم ­انگاري پورنوگرافي نوجوانان در فضاي مجازي است. مواد و روش ­ها: اين مطالعه تحليلي به­صورت هدفمند با استفاده از متون و مقالات منتشره مرتبط، آثار و عوامل مؤثر بر پورنوگرافي مجازي در نوجوانان را بررسي نموده و سپس، ملاحظات اخلاقي و حقوقي در مقابله با اين رفتار نابهنجار را مورد بحث قرار مي ­دهد. يافته­ ها: آثار مواجهه با پورنوگرافي در فضاي مجازي بر نوجوانان شامل مواردي همچون تمايل و كنجكاوي به رفتارهاي جنسي قبل از ازدواج، ترويج گفتمان ­هاي جنسي در بين آنان، رفتار غيرمسؤولانه و ارتباط نامناسب با خانواده است. سهولت دسترسي، گمنامي كاربران، نداشتن سواد رسانه ­اي و عدم نظارت، از عوامل مؤثر بر شكل­ گيري پورنوگرافي مجازي هستند. با اتخاذ راهكارهاي كيفري و غيركيفري در قالب پيش­گيري وضعي، اجتماعي و تدابير نظارتي مي­توان از ارتكاب اين بزه ممانعت كرد. از سوي ديگر لحاظ ­نمودن اصول اخلاقي همچون احترام به كرامت انساني، منع ضرر و احتياط در برخورد با امور مبهم، در مسائل مرتبط با فضاي مجازي و همچنين به­روز كردن قوانين همگام با پيشرفت فناوري از سوي قانون­ گذار امري ضروري است. نتيجه­ گيري: اگر چه نمي ­توان از مواجهه نوجوانان با پورنوگرافي در فضاي مجازي به­ طور كامل پيش­گيري كرد، اما مي ­توان با تقويت مؤلفه ­هايي چون تربيت جنسي فرزندان و نظارت بر نحوه استفادة آنان از فضاي مجازي و نيز وضع قوانين مبتني بر اصول اخلاقي آن را كنترل كرد.

Background and Aim: One of the most important risks for adolescents in useing the internet is to visit pornographic sites that are easily accessible to them. The aim of this study is to investigate the ethical and legal considerations in combating and criminalizing adolescent pornography in cyberspace. Materials and Methods: In this analytical study, texts and related published articles purposeful searched to examine the effects and factors influencing virtual pornography in adolescents and to discuss ethical and legal considerations in dealing with this abnormal. Findings: The effects of cyber pornography on adolescents include preference for premarital sexual behavior, promotion of sexual discourse among them, irresponsible behavior and poor family relationships. Ease of access, anonymity of users, lack of media literacy and lack of supervision are some of the factors influencing the formation of virtual pornography. By adopting criminal and non-criminal solutions in the form of situational, social prevention and regulatory measures, this crime can be prevented. On the other hand, it is necessary that the legislatore considers ethical principles such as respect for human dignity, prohibition of harm and caution in dealing with vague matters, in matters related to cyberspace, as well as enacting laws in line with technological progress. Conclusion: Although it is not possible to completely prevent adolescents from facing pornography in cyberspace, it can be controlled by strengthening components such as education of children and monitoring how they use cyberspace and also establishing rules based on ethical principles.
