Criticism of the Iranian Penal System's Approach to Crimes against the Environment (Human Geography) with a Look at International Conventions

حقوق محيط زيست در عصر حاضر بيش از هر زمان ديگر مورد توجه بين المللي قرار گرفته است، در اين ميان تببين نقش و جايگاه حقوق محيط زيست در نظام كيفري كشورها از اهميت زيادي برخوردار است چراكه ضمانت اجراهاي كيفري مهم ترين پاسخ به جرايم زيست محيطي است. رويكرد نظام كيفري ايران نيز درخصوص جرايم زيست محيطي همواره با چالش هاي فراواني مواجه بوده است و در عصر حاضر نيازمند نقد و اصلاح است. آنچه از بررسي قوانين داخلي مشخص است آن است كه قانونگذار كشور ما رويه يكسان و منسجمي در قبال جرايم زيست محيطي اتخاذ نكرده است. از طرف ديگر بطور كلي قوانين كيفري ايران در حوزه محيط زيست از رويكردهاي جهاني فاصله دارد و توجه به اسناد بين المللي و كنوانسيون ها در تدوين قوانين زيست محيطي از اهميت فراواني برخوردار است. لذا علاوه بر ايجاد يك رويكرد منسجم و يكپارچه در قوانين كيفري، توجه به اسناد بين المللي و همگامي با رويكردهاي بين المللي نيز بايد مورد توجه قانونگذار ايران باشد.

Environmental law has now received more international attention than ever before, and it is important to understand the role and status of environmental rights in countries' criminal systems, as guaranteeing criminal penalties is the most important response to environmental crimes. The Iranian penal system's approach to environmental crime has always faced many challenges and now requires criticism and reform. What is clear from the review of domestic law is that our country's legislator has not adopted a uniform and consistent approach to environmental crime. On the other hand, in general, environmental laws in Iran are far from global approaches and attention to international documents and conventions is important in the formulation of environmental laws.
