بازپژوهي معناي تغيير احكام شرعي و عوامل مؤثر بر آن

Reflection on the meaning of the change in religious law and its influencing factors

بحث از امكان و چگونگي تغيير احكام فقهي در دهه ­هاي اخير مورد توجه جريان­هاي فكري مختلفي قرار گرفته و متفكراني با مباني و انگيزه­ هاي متباين به آن پرداخته ­اند. مسئله­­­ ي اساسي در اين تحقيق، تبيين دقيق معناي «تغيير حكم» و تحليل سازكارهاي وقوعِ آن است؛ به گونه ­اي كه روشن شود آيا اين نام­گذاري، دقيق و حقيقي است يا تسامحي و مجازي؟ آثار نامطلوب برداشت­هاي نادرست از معنا و عوامل تغيير احكام، به ويژه شبه ­ي موقتي بودن احكام شرعي، ضرورت تحقيق در اين مورد را روشن مي­سازد. طبق نتايج به دست­ آمده، عواملي چون تغيير ماهوي موضوع، تغيير اوصاف موضوع، تغيير عنوان مأخوذ در موضوع، تغيير علت حكم و... مي توانند ـ اصطلاحاً ـ منجر به تغيير حكم شوند؛ البته تمام اين عوامل تحت عنوان جامع «تغيير موضوع» قرار دارند. بر اين اساس، اصطلاح تغيير احكام داراي تسامح است و آنچه در واقع رخ مي­دهد اين است كه همه ­ي احكام ثابت شرع در پي تحقق كامل موضوع خود فعليت مي­يابند و با خلل يافتن موضوع، حكمِ قبل از فعليت افتاده و حكم ثابت ديگري فعليت مي­يابد. نتيجه­ ي ياد شده افزون بر كاربرد كلامي در پاسخ­گويي به برخي شبهات، درك روشن­ تري را از هم­پوشاني تغيير حكم و تغيير موضوع، فراروي پژوهشگران قرار مي­دهد.

The discussion on the possibility and how to change the juridical instructions has attracted the attention of different intellectual currents and scholars have investigated it through different basics and motivations. The basic issue in this study is to explain the accurate meaning of “changing instruction” and analyzing the mechanisms of its venue; so that it clarifies whether this nomination is accurate and real or it is tolerant or virtual? The undesired effects of incorrect understanding of meaning and factors of changing instructions, especially the doubt on religious instructions temporality clarify the necessity to conduct such study. According to the results, factors including changing subject substantially, changing subject descriptions, changing the title of derivative in subject, changing the reason of instruction and…may –idiomatically- lead to the change of instruction; but all these factors are under the comprehensive title of “changing subject”. Accordingly, the expression of instructions change has tolerance and what happens in reality is that all fixed instructions of sharia are activated following the comprehensive achievement of their subject and by subject being disrupted, the previous instruction becomes inactivated and another fixed instruction activates. The mentioned result besides the verbal application in answering some doubts, offers a clearer understanding of overlap between instruction change and subject change before researchers.
