بررسي تأثير خلأهاي قانوني بر عملكرد فرماندهي كوپ پليس پيشگيري استان همدان

The Effect of the Legal Vacuum on the Kop Commander of the Prevention Police (Case study: Hamedan Province police commander)

هدف اين مقاله مطالعه تأثير خلأهاي قانوني مؤثر بر عملكرد فرماندهي كوپ‌ها ي پليس پيشگيري ناجا در استان همدان مي باشد ، كه از لحاظ هدف، كاربردي واز نظر روش تحقيق توصيفي از نوع پيمايشي مي باشد .جامعه آماري و حجم نمونة انتخاب شده در اين پژوهش شامل رؤسا و معاونان كوپ‌هاي فرماندهي انتظامي استان همدان به تعداد 90نفر است كه به صورت تمام‌شمار در تحقيق شركت داده شده‌اند.كه براي كسب اطلاعات دربارة ديدگاه‌ها، باورها و نظرات جامعة آماري پرسشنامه محقق ساخته با20گويه(سؤال) تنظيم و در سطح جامعه آماري تقسيم و داده‌هاي لازم جمع‌آوري شده‌است. نتايج اين پژوهش دلالت بر اين دارد كه اكثر افراد مورد مطالعه، خلأهاي قانوني را در عملكرد فرماندهي كوپ‌ها بسيار تأثيرگذار مي‌دانند، به طوري كه درخصوص خلأ قانوني در زمينة تبيين حدود اختيارات ضابطان قوة قضائيه71درصد، خلأ قانوني در زمينة اعتبار گزارش ضابطان قوة قضائيه نزد مقامات قضايي 61 درصد، خلأ قانوني در زمينة برخورد با اشخاص مظنون 77 درصد، خلأ قانوني در زمينة بازرسي از خودروها 81 درصد، ابهام قانوني دربارة مفهوم و تعيين مصاديق ضابطان قوة قضائيه 77 درصد، نمرة 10 و بالاتر داده اند و در مجموع، 81 نفر از افراد شركت كننده، نمرة 50 و بالاتر را اخذ نموده اند و بدين ترتيب، بر تأثيرگذاري اين موارد بر عملكرد فرماندهان كوپ صحّه گذاشته‌اند.

Statement of the problem and the objectives: The present study aimed at the analysis of the effects of effective legal vacuums on the function of NAJA prevention police of KOP commander. The study proved to be applicable from the goal prespective and benefitted from descriptive-experimental design in order to collect data on views, beliefs and the opinions of the subjects under study. The analytical findings of the study showed that the subjects under study recognize the legal vacuum to be effective on the function of the prevention police of KOPs commander. The results of this study imply that the majority of subjects under study, consider the legal gaps quite effective on the function of KOP command. The results of this study imply that the majority of subjects, legal gaps in knowledge, so that the cut is very effective in a legal vacuum role in restraining the judiciary with judicial officials, 61 percent of credit reports, the legal vacuum in dealing with persons suspected of 77 percent, 81 percent of cars inspected in a legal vacuum, a legal ambiguity about the meaning and examples of restraining the judiciary (77%), grade 10 and above have a total of 81 participants, received a score of 50 or higher, and thus the impact on the performance of these leaders have endorsed Kop.
