چكيده فارسي :
با شكل گيري نظام جمهوري اسلامي ايران، تدوين قانون در عرصه هاي مختلف اعم از اجتماعي، اقتصادي، سياسي و حقوقي جهت تعيين نوع خاصي از رفتار و عملكرد بشر در روابط اجتماعي بين افراد ضروري به نظر مي رسد، چرا كه هدف از برقراري قانون در هر نظامي تحقق نظم و امنيت در جامعه است. رعايت اخلاق و موازين اخلاقي نيز از يك طرف مي تواند در حفظ ارزش هاي يك جامعه مؤثر باشد و از طرف ديگر رعايت آن مي تواند منجر به احساس مسؤوليت اجتماعي در ميان افراد شود. رفتارهاي اقتصادي هر فرد، بستگي به اخلاق و عقايد و در نهايت عملكرد وي دارد، و وقتي بر اين رفتارهاي اقتصادي قوانيني وضع شود، همه افراد در برقراري روابط اجتماعي تابع آن خواهند شد و خود را ملزم به رعايت آن مي كنند. رفتارهاي اقتصادي انسان بر مبناي قانون متكي بر ارزش هاي اسلامي مي تواند منجر به رعايت اصول اخلاقي در انسان شود، از آنجا كه اخلاق انسان از درون وي سرچشمه مي گيرد لذا اين ارزشهاي اخلاقي از جمله عدالت، انصاف، آزادي و ... مي تواند در اخلاق اقتصادي فرد تأثير گذار باشد. اخلاق پيش زمينه هر فعاليت اقتصادي است، چرا كه مبادلات روزمره با رعايت اخلاق و اهميت قرار دادن اين مهم در زندگي اجتماعي هدف اصلي هر جامعه تلقي مي شود. توجه به مفهوم اخلاق و ورود آن به مباحث اقتصاد و سپس التزام انتقال آن به فضاي قانون مي تواند سرآمدي بر قوانين جهان باشد. مقاله حاضر ضمن بيان ارتباط اخلاق و اقتصاد و اخلاق اقتصادي، به بررسي مفهوم اخلاق در قوانين جمهوري اسلامي ايران اعم از قانون اساسي، قانون كار و قانون مجازات هاي اسلامي مي پردازد. در قوانين كار و مجازات اسلامي به واژه اخلاق صراحتاً اشاره شده است و در اصول قانون اساسي جمهوري اسلامي ايران نيز توجه به اصول و ارزش هاي اخلاقي مشاهده مي شود. روش تحقيق در اين مقاله توصيفي و تحليلي است. در اين مقاله هدف بررسي واژه اخلاق در مواضع اقتصاد، سياست و قانون در راستاي كارآيي نظام جمهوري اسلامي ايران است.

With the formation of the Iran Republic Islamic System, legislation in various areas, including social, economic, political and legal to determine the specific type of human behavior in social relations between individuals seem necessary, because the purpose of law enforcement in each military is realizing of order and security in society. Ethics and moral standards of one side can be effective in maintaining the values of a society and on the other hand respecting can lead to a sense of social responsibility among people. Economic behavior of each individual, depends on ethics and beliefs and his performance, when the economic behavior laws, all people follwer social relationships and their function will be required to follow it. Human economic behavior based on the law and based on Islamic values could lead to ethics in humans, as human morality comes from within him. So the moral values such as justice, fairness, freedom can effect on ethic economic. Ethic is background of economic activity, because everyday exchanges with ethics and the importance of putting the main goal of any society is seen as important in social life. According to the concept of ethic and enter to the economics and then necessity of transfer law it can be appointed to rule the world. This article expresses the relationship between ethics and economics, economic ethics, the concept of ethics in the Islamic Republic of Iran laws, including the constitution, Islamic law and the Penal Code deals with the labor laws and the Penal and expressly Ethics in the constitution of the Islamic Republic of Iran according to the principles and values can be seen. Research method in this article is describing. The purpose of the article is investigating the Ethics in economic positions, politics and law in the purpose of efficiency in the Islamic Republic of Iran.
