شناسايي موانع پيش روي سرمايه گذاري با تاكيد بر واگذاري اراضي دولتي(مطالعه موردي نيروگاه هاي خورشيدي و مقياس كوچك در استان كرمان)

Identify the obstacles of investment with emphasis on assigning of government land (Case study: solar and small scale power plants in Kerman province

بهبود محيط كسب وكار هر كشور با فراهم كردن شرايط رقابت پذيري و بسترسازي مناسب براي ورود موثر بخش خصوصي، نقش تعيين كننده اي در توسعه سرمايه گذاري ايفا مي كند. از اين رو همه كشورها براي ايجاد فضاي كسب و كار مناسب، تمام تلاش خود را به كار بسته و به صورت مداوم در حال برنامه ريزي براي انجام اصلاحات مقتضي هستند. يكي از عوامل مهم كه فرايند شروع كسب و كار در كشور را با چالش مواجه كرده است، اخذ مجوزهاي قانوني مي باشد. مجوز واگذاري زمين هاي دولتي براي طرح هاي توليدي از جمله مهم ترين و زمان برترين اين مجوزها است. هدف از مطالعه حاضر، بررسي دقيق فرايند واگذاري اراضي ملي و دولتي به طرح هاي سرمايه گذاري و پاسخ به اين سوال است كه چرا اين فرايند بسيار طولاني و زمان بر است. بدين منظور، پس از بيان مباني قانوني واگذاري اراضي ملي و دولتي و فرايند واگذاري اين اراضي، 19 پرونده واگذاري به مجريان نيروگاه هاي خورشيدي و مولد مقياس كوچك استان كرمان به صورت ميداني بررسي و متوسط زمان انجام هر گام محاسبه شده است. نتايج نشان مي دهد استعلامات قانوني از دستگاه هاي اجرايي مختلف كه به طور متوسط يك ماه زمان مي برد و نيز وجود كارگروه ها و كميته هاي تخصصي متعدد كه به صورت متوالي و در فواصل زماني نامنظم و طولاني تشكيل مي گردند، در غياب يك نظام اداري كارآمد باعث شكل گيري يك فرايند اداري نفس گير براي متقاضيان زمين هاي دولتي شده است. در انتها پيشنهادها و راهكارهاي اجرايي بيان شده است.

Improving the business environment in each country by providing competitive conditions and appropriate context for effective entry of the private sector plays a crucial role in enhancing the investment, production and employment. Therefore, all countries are working hard to create a proper business environment and are constantly planning to implement reforms. One of the key factors that has challenged the process of starting a business in our country is obtaining legal licenses. The licensing of assigning government land for investment plans is one of the most important and time-consuming of these licenses. The purpose of this study is to carefully examine the legal procedure of assigning government land to investment plans and answer to this question why the procedure is so long and time-consuming. For this purpose, after explaining the legal bases of the assignment of government land and its legal procedure, 19 cases of land assignment on lease for solar and small scale power plants projects were surveyed and the average time of each step was measured. The results show that there are two main problems with the legal procedure of government land assignment, which emphasize an inefficient administrative system: a. legal inquiries from different governmental organizations, which takes an average of one month; b. the existence of numerous specialized committees, which are held sequentially and at irregular, long intervals. At the end, there are also executive suggestions.
