چكيده فارسي :
ﻗﺎﻧﻮن آﯾﯿﻦ دادرﺳﯽ ﮐﯿﻔﺮي 1392 ﺑﯽ ﺗﺮدﯾﺪ، ﮔﺎمﻫﺎي ﻣﻬﻤﯽ را در راﺳﺘﺎي رﻋﺎﯾﺖ ﺣﻘـﻮق و آزادي-ﻫﺎي ﻓﺮدي و ﮐﺮاﻣﺖ اﻧﺴﺎﻧﯽ، ﺑﻪ وﯾﮋه درﺑﺎرة ﺣﻘﻮق ﻣﺘﻬﻢ ﺑﺮداﺷﺘﻪ اﺳﺖ. اﯾﻦ ﺗﺤﻮﻻت ﭼﯿﺰي ﺟﺰ رﻋﺎﯾـﺖ ﻣﻮازﯾﻦ ﺣﻘﻮق ﺑﺸﺮي ﻣﻨﺪرج در اﺳﻨﺎد ﺑﯿﻦاﻟﻤﻠﻠﯽ ﺣﻘﻮق ﺑﺸﺮ، ﺑﻪ وﯾﮋه ﻣﯿﺜﺎق ﺑﯿﻦاﻟﻤﻠﻠـﯽ ﺣﻘـﻮق ﻣـﺪﻧﯽ و ﺳﯿﺎﺳﯽ 1966 م، و اﺻﻮل ﻗﺎﻧﻮن اﺳﺎﺳﯽ ﺟﻤﻬﻮري اﺳﻼﻣﯽ، ﻧﯿﺴﺖ ﮐﻪ ﺑـﻪ ﻣﻮﺟـﺐ آن، ﮐﻨﺸـﮕﺮان ﻓﺮاﯾﻨـﺪ ﮐﯿﻔﺮي ﺑﻪ رﻋﺎﯾﺖ اﺻﻮل دادرﺳﯽ ﻣﻨﺼﻔﺎﻧﻪ و ﺗﺄﻣﯿﻦ ﺣﻘﻮق دﻓﺎﻋﯽ ﻣﺘﻬﻤﺎن ﻣﮑﻠﻒ ﻣﯽﺷﻮﻧﺪ. اﯾﻦ ﭘﮋوﻫﺶ از ﻧﻮع ﺑﻨﯿﺎدي ﻣﯽﺑﺎﺷﺪ و در آن، ﺑﺎ روﯾﮑﺮدي ﺗﺤﻠﯿﻠﯽ و ﺗﻮﺻﯿﻔﯽ ﺑﻪ ﺑﺮرﺳﯽ ﺣﻘﻮق ﻣﺘﻬﻢ در ﭘﺮﺗﻮ ﻗﺎﻧﻮن آﯾﯿﻦ
دادرﺳﯽ ﮐﯿﻔﺮي ﺳﺎل 1392 و ﺗﻄﺒﯿﻘﯽ آن ﺑﺎ ﺣﻘﻮق در ﮐﺸﻮر اﻧﮕﻠﯿﺲ ﭘﺮداﺧﺘﻪ ﺷﺪه اﺳﺖ. ﺑﺮ اﯾـﻦ اﺳـﺎس ﻣﺸﺨﺺ ﮔﺮدﯾﺪ ﮐﻪ در ﻗﺎﻧﻮن ﺟﺪﯾﺪ ﻣﺼﻮب 1392، ﺣﻘﻮق دﻓﺎﻋﯽ ﻣﺘﻬﻢ، ﺑﺎ ﭘﯿﺶﺑﯿﻨﯽ ﻣﻮازﯾﻨﯽ ﻣﺎﻧﻨﺪ: ﺣـﻖ ﻣﻄﻠﻊ ﺳﺎﺧﺘﻦ ﺧﻮﯾﺸﺎوﻧﺪان، ﺑﺮﺧﻮرداري از وﮐﯿﻞ، ﺣﻖ ﻣﻌﺎﯾﻨﮥ ﭘﺰﺷﮑﯽ و ﺣﻖ ﻣﻄﻠﻊ ﺷﺪن از ﺣﻘﻮق دﻓﺎﻋﯽ ﺧﻮد، ارﺗﻘﺎي زﯾﺎدي ﯾﺎﻓﺘﻪ اﺳﺖ. ﻫﻤﭽﯿﻦ در ﺗﻄﺒﯿﻖ ﻗﻮاﻧﯿﻦ دو ﮐﺸﻮر ﻣﺸﺨﺺ ﮔﺮدﯾﺪ ﻋﻼوه ﺑﺮ ﻫﻤﺴﺎﻧﯽﻫﺎ، ﺗﻔﺎوت زﯾﺎدي ﻫﻢ ﺑﯿﻦ ﻗﺎﻧﻮن آﯾﯿﻦ دادرﺳﯽ ﻣﺼﻮب ﺳﺎل 1392 ﮐﺸﻮر ﻣﺎ و ﻗﺎﻧﻮن ﮐﺸﻮر اﻧﮕﻠـﯿﺲ وﺟـﻮد دارد. ﺑﺎ اﯾﻦ ﺗﺤﻘﯿﻖ، ﻣﺰﯾﺖﻫﺎ و ﻧﻘﺎط ﻣﺜﺒﺖ ﻗﺎﻧﻮن آﯾﯿﻦ دادرﺳﯽ ﮐﯿﻔـﺮي ﻣﺼـﻮب 1392 و اﻧﻄﺒـﺎق آن ﺑـﺎ ﻣﻮازﯾﻦ ﺣﻘﻮق ﺑﺸﺮي، ﺑﻬﺘﺮ اﺛﺒﺎت ﮔﺮدﯾﺪ.
چكيده لاتين :
The Criminal Procedure Code of 2013 has undoubtedly taken important steps towards respecting individual rights and freedoms and human dignity, especially with regard to the rights of the accused. These developments are nothing but observance of the human rights standards set forth in international human rights instruments, in particular the International Covenant on Civil and Political Rights of 1966, and the principles of the Islamic Republic's constitution, whereby criminal process actors comply with the principles of justice. The defendants are required to provide a fair and equitable defense. This research is a fundamental one. In this descriptive and analytical approach, the law examines the rights of the accused in the light of the Criminal Procedure Code of 2013 and its comparison with the law in the UK.It was found, therefore, that in the new law adopted in 2013, the defendant's defense rights have been greatly improved, with provisions such as: the right to know relatives, the right to counsel, the right to medical examination and the right to be informed of his or her defense rights. Similarly, in the implementation of the laws of the two countries, it was noted that in addition to the similarities, there is a large difference between the law of our country adopted in 2013 and the law of the United Kingdom. With this research, the advantages and disadvantages of the Code of Criminal Procedure adopted in 2013 and its compliance with human rights standards were further substantiated.
