تحقيق حاضر به بررسي نقش اختلالات رواني غير از جنون در ارتكاب جرم و تاثير آن بر مسئوليت كيفري اشخاص پرداخته است. آنچه موجب نگارش اين مقاله گرديد، وجود خلاء و ابهام در تعيين نوع مسئوليت آن دسته از بيماراني است كه هر چند از حيث رواني دچار آسيب­هاي شديد شده اند ليكن به لحاظ نوع تقرير مواد مربوط به مسئوليت جزايي، اين دسته از مرتكبان در حيطه لفظ جنون نگنجيده و به ناچار، داراي مسئوليت تام كيفري شناخته مي­شوند. پژوهش، به روش تحليلي و استفاده از منابع كتابخانه ­ايي نظير كتب و مقالات ارائه شده و بهره ­مندي از تحقيق ­هاي انجام گرفته در علم روان پزشكي و نيز مطالعه تطبيقي قوانين مرتبط در ايران با كشور آمريكا و انگليس است كه به اين نتيجه نائل آمده كه عبارت جنون به دليل اينكه به وجود برخي از حالات رواني و دروني انسان دلالت مي­كند و اين حالت­ ها بسيار ظريف و متغير هستند، قابل تعريف نخواهد بود و بايستي از تعريف اين عبارت در پي جعل آن به منظور پيشگيري از نقايص موجود اجتناب نمود.
