The role of promoting virtue and preventing vice in crime prevention

علماي حقوق جزا و جرم‌ شناسي علل و عوامل مختلفي را در تحقق جرم و به طور كلي پديده ي مجرمانه مؤثر مي‌دانند؛ ليكن به نظر اين دانشمندان تأثير هر يك از علل و عوامل برحسب شرايط، اوضاع و احوال متفاوت خواهد بود، به نحوي كه فرد بر اساس ميزان تأثير هر كدام از اين شرايط بر ديگري بازيگري نقش مجرمانه را در جامعه به عهده مي-گيرد. اين عوامل گاهي در خود فرد وجود دارد و گاهي جامعه او را در ايفاي اين نقش ياري مي‌نمايد. دانشمندان اين رشته از علم حقوق با طرح ديدگاه هاي متنوعي تلاش نموده‌اند تا ضمن شناسايي كليه ي عوامل جرم‌زا روش‌هاي مختلفي را براي پيشگيري از وقوع جرم بر اساس مباني ديدگاه خود ارائه نمايند كه وجود ديدگاه‌هاي متعدد حاكي از جامع نبودن هر يك از شيوه‌ها به تنهايي در پيشگيري از جرم مي‌باشد. تأثيرپذيري اين رشته از علوم انساني از حقوق غرب موجب گرديده در ايران جرم‌شناسي اسلامي كه توان پاسخ گويي به كليه ي سؤالات مرتبط با جرم و پيشگيري را دارد، كم تر مورد توجه حقوق‌دانان قرار گيرد. در نوشته ي حاضر ضمن پرداختن مختصر به مفاهيم جرم و پيشگيري در حقوق جزا و جرم‌شناسي، مفهوم پيشگيري از منظر جرم‌شناسي، تاريخ قرآني پيشگيري، مفهوم و ضرورت امر به معروف و نهي از منكر، آثار معنوي، اجتماعي، سياسي، اقتصادي و فرهنگي آن مورد بررسي قرار گرفته و اين فرضيه كه يكي از مباني مهم نظري و نيز كاربردي پيشگيري از هر گونه كج مداري و جرم، عمل به معروف و پرهيز و دوري از منكرات بر اساس دستورات قرآن كريم مي‌باشد، به اثبات رسيده است.

Criminal law and criminology experts regard various factors as influential in crime commitment and generally criminal act. But they are on the belief that the effect of each of these factors will be different in different conditions and situations i.e. the individual based on the level of effect of each of those conditions on the others, take on a criminal role in society.ese factors are sometimes within the individual and some other times the society pushes them to take on the role. Through putting forward various viewpoints, the scientists of this branch of law science have tried to both detect all the factors of crime commitment and offer various ways of preventing the crime prevention based on their viewpoint’s principles. The existence of various viewpoints indicates the incomprehensibility of each of those ways in crime prevention. Although Islamic criminology is capable of answering all the questions related to crime prevention, being under the influence of western law deprived it from receiving the due attention by the experts of law. The present piece of writing has shortly elaborated on the concepts of crime and prevention in criminal law and criminology, the concept of prevention from criminology point of view, the prevention history of Quran and the concept and necessity of promoting virtue and preventing vice as well as spiritual, social, political, economical and cultural literature works. This hypothesis is among the main theoretical and applied bases of preventing every type of misdemeanor and crime, doing virtue and preventing wrongdoings based on the Quran’s orders.
