چكيده فارسي :
شهرداري‌ها از بزرگ‌ترين مؤسسات عمومي غيردولتي در سطح شهرها محسوب مي‌شوند كه نقشي اساسي در روند اداره‌ي شهرها بر عهده دارند. با پيشرفت و توسعه‌ي شهر و شهرنشيني در ايران، آثار حقوقي ناشي از اجراي قوانين و طرح‌ها از سوي شهرداري بيشتر رخ نشان مي‌دهد و گاهي همچون يك مانع جدي در مقابل عملكرد نهاد مذكور، مي‌تواند مدت‌ها اجراي فعاليت‌ها را به تعويق اندازد و حتي آن‌ها را با شكست مواجه سازد. تعدد قوانين شهري، تداخل اين قوانين با منافع خصوصي افراد و نهادينه‌نشدن تقدم حقوق عمومي بر حقوق مالكانه، ضرورت بررسي قوانين و طرح‌هاي شهرداري را اين بار از حيث موانع حقوقي آشكار مي‌سازد. اين پژوهش به بررسي معايب و معضلات شهرداري مي‌پردازد و روش تحقيق در آن از نوع توصيفي-تحليلي است و ابزار گردآوري داده‌ها، ميداني و اسنادي مي‌باشد. يافته‌ها حاكي از آن است كه علت اصلي مشكلات و معايب و معضلات شهرداري‌ها، گستردگي و تنوع اختيارات و مسئوليت‌هاي آن‌ها بر اساس قوانين شهرداري‌ها است.
چكيده لاتين :
Municipalities in metropolitan areas are the largest non-governmental public institutions that play a key role in the process are responsible for managing cities. With the advancement and development of cities and urbanization in Iran, the legal effects resulting from the implementation of projects by the municipality showed himself more and sometimes as a serious obstacle to the functioning of the institutions, for the implementation of activities can delay or even make them fail. The multiplicity of municipal laws, these laws interfere with the private interests of individuals and the lack of institutionalization of public rights of way on municipal property rights necessary laws and initiatives needed this time in terms of legal obstacles. This study examines the flaws and problems in the municipality pays and descriptive-analytic research method and data collecting tool is filed and documents. The finding indicate that the main cause of problems and issues of the municipalities and the diversity of the powers and responsibilities in accordance with the laws of the municipalities.
