چكيده فارسي :
امروزه پليس به طور رسمي نيروي اصلي مسئول حفظ امنيت داخلي در جامعه است. در واقع پليس سازماني دولتي است كه به نيابت از دولت و بر طبق قانون و در حدود وظايف و اختيارات محوله قانوني مسئول برقراري نظم و امنيت و اعمال و اجراي قانون به ويژه حقوق كيفري مي باشد. امنيت نيز از جمله حقوق طبيعي و مقدم انسان و اساس برخورداري از ديگر حقوق و آزادي‌هاي اساسي انسان است. مفهوم امنيت به عنوان شرط بنيادين حيات انساني در همه جاي دنيا و اكثر اسناد بين‌المللي و قوانين اساسي كشورها قابل درك بوده و همواره مورد تأكيد قرار گرفته است و تأثيرات اساسي در زندگي بشر دارد. از طرفي همواره اشخاصي در همه جوامع وجود دارند كه با رفتارهاي نامعقول و ناهنجار خود سعي در برهم زدن نظم و امنيت عمومي جامعه دارند. از اين رو پليس ضمن دانستن اصولي وظايف و اهداف نيروهاي پليس براي برقراري و حفظ نظم و امنيت داراي اختيارات ويژه اي مانند اجازه استفاده از سلاح گرم تحت شرايط قانوني، استفاده از شكنجه، اجازه سلب آزادي و... است. بنابراين پليس بايد حدود و اختيارات خود را در استفاده از اين ابزارهاي قانوني در حفظ نظم بداند، زيرا ممكن است پليس در راستاي برقراري نظم و امنيت كه هدف و مأموريت ذاتي اوست، باعث تعرض به حقوق ساير شهروندان و ايجاد اختلال در نظم جامعه شود. در نتيجه اعطاي چنين اختياراتي به سازمان هاي پليس بايد در پرتو قوانين محدود و صريحي باشد كه بقاي نظم و امنيت جامعه را تضمين نمايد.

Today, the police are officially the main force responsible for maintaining internal security in the community. In
fact, police is a government agency that is responsible for maintaining order, security, law enforcement, and law
enforcement, in particular criminal law, at the discretion of the government and within the limits of its statutory
duties and powers. Security is also one of the natural and fundamental rights of human beings and the basis for
the enjoyment of other fundamental human rights and freedoms. The concept of security is understood as a
fundamental requirement of human life everywhere in the world and in most international documents and laws
of the countries, and has always been emphasized and has major implications for human life. On the other hand,
there are always people in all societies who try to disrupt the public order and security of society by their
irrational behavior. Therefore, while recognizing the principles and duties of police forces to maintain order and
security, the police have special powers, such as permitting the use of firearms under legal conditions, the use of
torture, and the deprivation of liberty. Therefore, the police must know their limits and powers in the use of these
legal tools in order to maintain order, as the police may violate the rights of other citizens and disrupt the order
of society in order to restore order and security, which is its essential purpose and mission. As a consequence,
the granting of such powers to police organizations must be in the light of restrictive laws that guarantee the
survival of order and security in society.
