تمايل روز افزون به استفاده از فناوري هاي پيشرفته از جمله رايانه و اينترنت شرايط و بستر مساعدي براي ظهور جرايم سايبري به وجود آورده است از آنجا كه اين جرايم در فضاي مجازي انجام مي شوند و مانند ساير جراحي ملموس نيستند مراجع قضايي و انتظامي براي پيشگيري از اين جرايم و كشف آنها با چالش هاي نوين مواجه است . كشور ما به هيچ كدام از كنوانسيون هاي بين المللي مربوط به جرايم سايبري نپيوسته است و با توجه به خلاء موجود در قوانين داخلي نيروهاي انتظامي براي پيشگيري از اين جرايم و كشف آن ها در عمل با مشكلاتي مواجه هستند و اين در حالي است كه امروزه پليس با استفاده از فناوري هاي نوين كه در عرصه نرم افزارهاي تخصصي پليس به وجود آمده است ، پيشگيري از وقوع جرايم مزبور نقش موثري داشته باشد بنابراين لايحه قانون مجازات جرايم رايانه‌اي كه مدت ها است در دستور كار مجلس شوراي اسلامي قرار گرفته بايد هر چه سريعتر به تصويب برسد تا به مرحله اجرا گذاشته شود تا پاريس بتواند به عنوان حافظ نظم و امنيت در فضاي مجازي نقش موثري خود را ايفا كند از آنجا كه جرايم سايبري ويژگي هاي منحصر به فردي دارند. جرايم سايبري و نقش پليس در پيشگيري از اين جرايم و كشف آن ها ماموراني كه به كشف و بررسي اين جرايم مي پردازند، بايد آموزش‌هاي تخصصي وسيع و جامعه اي را در خصوص رايانه و اينترنت فرا بگيرند تا در اين زمينه به نتايج مطلوب تري دست يابد، با توجه به آنكه دلايل ارتكاب جرم در فضاي مجازي عمدتاً ادله الكترونيك مي باشد ضرورت آموزش هاي تخصصي در خصوص رايانه و اينترنت به ماموران پليس بيشتر آشكار مي شود.
