نيروي انتظامي جمهوري اسلامي ايران به عنوان ضابط دادگستري در اجراي قانون، عهده‌دار وظايف متعدد، متنوع، سخت و مسئوليت‌آوراست. اجراي صحيح وظايف ومقررات توسط كاركنان پليس مورد تأكيد قانون گذار و خواست جامعه مي باشد. بخش مهمي ازوظايف قانوني مربوط به برقراري نظم وامنيت، پيشگيري ازجرم، تعقيب و دستگيري مجرمين، اجراي دستورات مقام قضايي، اجراي احكام مدني وكيفري، درابعادمختلف آن،برعهده ناجا است.يكي از واحد هاي تخصصي نيروي انتظامي ،يگان ويژه مي باشد كه در ماموريت هاي مقابله با شورش هاي شهري ،اجتماعات غير قانوني،انواع ناآرامي ها و به عنوان يگان پشتيباني كننده پليس هاي تخصصي در ورزشگاه ها انجام وظيفه مي نمايد.گاهي ممكن است انجام وظايف محوله، موجبات وقوع حوادث زيان‌بار و ايرادخسارت به اشخاص حقيقي وحقوقي شود و در نتيجه سبب تحقق مسئوليت كيفري يامدني براي كاركنان وياسازمان ناجا را به دنبال داشته باشد. لذا آشنايي كاركنان ناجا با مصاديق مسئوليت مدني باعث پيشگيري هر چه بيشتر از حوادث و افعال زيان بار شده و در نتيجه باعث ارتقاء عملكرد در انجام ماموريت ها مي گردد.هدف در اين مقاله بررسي وتبيين قواعدفقهي وحقوقي و مباني ومنابع عام وخاص مسئوليت مدني ،مصاديق قانوني مسئوليت مدني پليس ، مواد مرتبط درقانون اساسي، مجازات اسلامي، مسئوليت مدني، قانون بكارگيري سلاح ، قانون مدني و شيوه هاي جبران خسارت از وقوع فعل زيانباربر اساس تقصيرپليس است. جمع‌بندي نهايي نيز بيانگر آن است كه بيشترين دعاوي در حال رسيدگي در مراجع قضايي مرتبط با تيراندازي و تصادفات است و با وجود تلاش بسياري كه براي كاهش اين آمارها صورت گرفته، اما ناكارآمد بودن وكافي نبودن برخي روش‌ها يا بي‌توجهي مأموران به برخي از اين ضوابط، موجبات مسئوليت مدني را فراهم آورده است كه ضروري به نظر مي رسد آموزش حين خدمت،توجيه و نظارت به روش كاربردي صورت پذيرد.
