مطالعه تطبيقي بازرسي و تفتيش از اماكن در اجراي وظايف پليس ايران و انگلستان

Adaptive Study of Inspection and Search of Places in Executing Iran and England’ Police Duties

بازرسي و تفتيش از جمله اقدامات مهم و تأثير گذاري است كه در تحقيقات مقدماتي و يا تكميلي توسط ضابطان دادگستري در جهت كشف جرم بعمل مي‌آيد اين مسئله موجب گرديده است كه وظايف و اختياراتي بر عهده ضابطان دادگستري طبق قوانين و مقررات مدون قرار داده شود. موضوع مورد تحقيق با هدف مطالعه تطبيقي بين حقوق ايران و انگليس در وظايف و اختيارات پليس در بازرسي و تفتيش از اماكن انجام مي‌گردد. ضابطان دادگستري در راستاي كشف و حفظ آثار و ادله وقوع جرم و ادله شناسايي و دستگيري متهم و همچنين جلوگيري از فرار متهم و غيره گاه مجبور به استفاده از روش بازرسي و تفتيش مي باشند با توجه به نقش و تأثير اين روش در كشف و پيشگيري از جرم و همچنين ضابطان دادگستري به اقتضاي مأموريت هاي محوله به خود (ايجاد و حفظ نظم و امنيت) تمايل دارند كه از اختيارات گسترده‌اي برخوردار باشند ليكن نهادهاي قانونگذار، حقوقدانان، قضات و وكلاء با تأكيد بر رعايت و احترام به حقوق شهروندي با اين امر مخالفت مي‌نمايند. موضوع بازرسي و تفتيش از اماكن در بيشتر مواقع در خصوص مظنونين و متهمين به ارتكاب جرم انجام مي‌شود بايستي عنايت داشت كه اين امر به گونه‌اي صورت پذيرد كه حقوق افراد مظنون و متهم نيز بصورت متعادل و متوازن مورد حمايت و رعايت قرار گيرد زيرا كه ناديده گرفتن اين حقوق موجب عدم رعايت انصاف، عدالت و قانون خواهد بود.

Inspection and search are considered as important and impressive measures that are conducted in preliminary or supplementary investigations by Judiciary agents in detecting crimes. This issue has put duties and authorities upon the Judiciary agents in line with codified laws and regulations. The issue under research is carried out with the aim of adaptive study of Iran and England’s laws in duties and authorities of police in inspecting and searching places. The Judiciary agents along with detecting and safeguarding evidence and traces of crime perpetration and evidence of identifying and arresting the accused and preventing the accused from running away and the like, as well, are obliged to use inspection and search method. In regards to the role and impact of this method in detecting and preventing crimes and considering the fact that the Judiciary agents are usually willing to have vast authorities in their assigned tasks (restoring order and security), as well, but legislative agencies, lawyers, judges and attorneys disagree with this issue emphasizing civil liberties and rights. The issue of inspection and search of places are frequently carried out particularly against suspects and the accused. It should be noted that this issue be carried out in a manner that the rights of the suspects and accused be proportionally and moderately protected and observed because ignoring this right will cause lack of fairness, justice and law.
