ابعاد حقوقي «امنيت زيست محيطي» در قزاقستان

Legal Aspects of "Environmental Security" in Kazakhstan

بهبود نسبي شرايط زندگي در بوم سازگان قزاقستان طي دو دهه گذشته تا حد زيادي پيامد توسعه نهادي و حقوقي اين كشور در حوزه حفاظت از محيط زيست بوده است. هدف مقاله حاضر ، ارزيابي حكمراني زيست محيطي قزاقستان از چشم انداز روند قانون گذاري و تحولات حقوقي و تأثير آن بر امنيت زيست محيطي در اين كشور طي سه دهه گذشته است. بر اين پايه، پرسش اصلي مقاله اين است كه «تحول در ابعاد قانوني و حقوقي حكمراني زيست محيطي در قزاقستان از زمان استقلال تا به امروز چه پيامدهايي بر امنيت زيست محيطي در اين كشور داشته است؟» در مقابل اين فرضيه به آزمون گذاشته شده است كه «تغييرات قانوني و حقوقي در حكمراني زيست محيطي قزاقستان از زمان استقلال تا به امروز به دليل تدوين تدريجي قوانين سخت گيرانه تر براي حفاظت از محيط زيست، ايجاد ساختار مديريت يكپاچه حفاظت از محيط زيست، استفاده از تجارب ساير كشورها در حوزه مديريت زيست محيطي و نيز ارتقا همكاري هاي زيست محيطي بين المللي به بهبود نسبي امنيت زيست محيطي در اين كشور منجر شده است». مقاله حاضر از نوع كتابخانه اي بوده و از روش توصيفي-تحليلي بهره برده است و چارچوب مفهومي حاكم بر آن را تعاريف و گزاره هاي نظري مفهوم امنيت زيست محيطي تشكيل ميدهد. يافته هاي مقاله ضمن تأييد فرضيه نشان مي دهند، مجموعه قوانين جديد زيست محيطي قزاقستان مي تواند به شرط پياده سازي مؤثر در مرحله اجرا با يكپارچه سازي قوانين حوزه هاي گوناگون محيط زيست و ايجاد سازگاري قوانين زيست محيطي با شرايط واقعي حاكم بر سطوح محلي، ملي و بين المللي به ارتقا عملكرد زيست محيطي اين كشور طي سال هاي آينده منجر شود.

The relative improvement of the living conditions in Kazakhstan's ecosystem over the past two decades has mostly been the result of institutional and legal development of the country in protecting the environment. This paper is to assess the environmental governance of Kazakhstan from the perspective of the legislative process and legal developments and its impact on environmental security in this country over the past three decades. Accordingly, the main question is: "What are the environmental security consequences of the developments in the legal aspects of environmental governance in Kazakhstan since independence?" The hypothesis tested in this paper is: “due to the gradual development of stricter laws for environmental protection, the creation of an integrated management structure for environmental protection, applying the experiences of other countries in the field of environmental management, as well as promoting international environmental cooperation, legal developments in the environmental governance of Kazakhstan since independence have led to a relative improvement in environmental security”. This paper is descriptive-analytical and the conceptual framework governing it consists of definitions and theoretical propositions of the concept of environmental security. While confirming the hypothesis, the findings show that Kazakhstan's new set of environmental laws may lead to improving its environmental performance in the coming years in case of efficient implementation through integrating laws in various environmental areas and making environmental laws compatible with the real conditions prevailing at local, national and international levels.
