درآمدي بر نقش مقررات زدايي در بعد ملي و فراملي در بهبود كيفيت اجراي حق توسعه اقتصادي: با تاكيد بر قانون برنامه ششم توسعه ايران

An Introduction to the Role of Deregulation in the national and transnational dimension in Improving the Quality of Implementation of the Right to Economic Development: Emphasizing the Act of the Sixth Development Plan of Iran

امروزه در خصوص اجراي حق توسعه اقتصادي يا توليت آن بوسيله دولت كمتر جدالي مطرح است بلكه بحث اساسي بهبود كيفيت اجراي حق مذكور است. در اين باب، مقررات زدايي به عنوان يك مكانيزم موثر مورد توجه مي باشد. مقررات زدايي ابزاري است كه اجراي مطلوب حق توسعه اقتصادي را در قالب كاهش دخالت دولت در اقتصاد و ايجاد بسترهاي حضور بخش خصوصي در بازار فراهم مي كند. براي اين منظور با حذف يا كاهش مقررات مانع درحوزه هاي توليدات داخلي و فضاي كسب و كار، سرمايه گذاري خارجي، اشتغال، دسترسي به بازار آزاد و خصوصي سازي اجراي مطلوب حق توسعه اقتصادي را تضمين مي نمايد. بر اين اساس مقررات زدايي در قانون برنامه هاي پنج ساله توسعه در ايران خصوصا قانون برنامه ششم مد نظر بوده است. اما همچنان در اين خصوص اين پرسش مطرح است كه مقررات زدايي با چه مكانيزمي، مي تواند بهبود كيفيت اجراي حق توسعه اقتصادي را تضمين نمايد؟ همچنين، قابليت قانون برنامه ششم توسعه در كاهش چالش هاي احتمالي بهره گيري از مكانيزم مقررات زدايي قابل بحث است. اين پژوهش، ضمن بيان پاسخ پرسش هاي فوق، پيشنهادات لازم اعم از وضعي و اصلاحي را جهت تحقق موضوع، ارايه نموده است.

Today, there is less controversy about the implementation of the right to economic development or its custody by the government, but the main issue is to improve the quality of implementation of this right. In this regard, deregulation is considered as an effective mechanism. Deregulation is a tool that provides the proper implementation of the right to economic development in the form of reducing government interference in the economy and creating the conditions for the presence of the private sector in the market. To this end, by eliminating or reducing barriers in the fields of domestic production and business environment, foreign investment, employment, access to the free market and privatization guarantees the proper implementation of the right to economic development. Accordingly, deregulation has been considered in the law of five-year development plans in Iran, especially the law of the sixth plan. But the question remains, what mechanism can deregulation guarantee to improve the quality of implementation of the right to economic development? Also, the ability of the Sixth Development Plan Act to reduce the potential challenges of using the deregulation mechanism is debatable. This study, while answering the above questions, has provided the necessary suggestions, both status and correction, to realize the issue.
