بررسي فقهي نسب و آثار حقوقي آن در شبيه سازي انساني

شبيه سازي يا كلونينگ، از روشهاي نوپيداي عالم پزشكي در درمان ناباروري است كه برخلاف توليد مثل طبيعي، توليد موجود زنده بدون انجام عمل لقاح و حاصل تركيب يك سلول جسمي و يك سلول جنسي مي باشد. حق انتساب طفل به پدر و مادر خود، يكي از اساسي ترين حقوق انساني به شمار مي رود. مقاله حاضر در پي پاسخ گويي به سؤالات و چالش هاي موجود در بررسي فقهي وضعيت نسب در طفل شبيه سازي شده است. در اينجا توليد مثل جنسي با منشأ دوگانه (پدر و مادر) در خصوصيات ژنيتيكي طفل و توليد مثل شبيه سازي با منشأ واحد (پدر يا مادر) مورد مقايسه قرار مي گيرند و علاوه بر اين، جواز شبيه سازي در چارچوب رابطه زوجيت يا خارج از آن نيز مطرح مي شود. هركدام از فرض هاي موجود، نتايج متفاوتي به دست مي دهد كه جنبه هاي مختلف آن در آراي فقهاي اماميه بررسي مي شود و در پايان نظر مختار بيان مي گردد كه اولاً نسب در شبيه سازي وجود دارد ثانياً پدر و مادر صاحب سلول به عنوان پدر و مادر فرزند كلون شده، يعني صاحب سلول و فرزند حاصل از صاحب سلول، دوقلوي هم محسوب مي شوند. همچنين آثار نسب شامل حرمت نكاح، حضانت طفل، ولايت قهري، الزام به انفاق، وصيت و توارث خواهد بود.
