عقد نكاح موقت يكي از احكام اختصاصي فقه جعفري است كه در برخي از احكام با عقد دائم متفاوت است. يكي از احكامي كه معركه آراي فقها قرار گرفته بحث ارث در نكاح منقطع است. در اينكه آيا زوجين از يكديگر در عقد نكاح موقت ارث مي برد يا خير اختلاف زيادي وجود دارد كه اين اختلاف ناشي از روايات موجود در باب است. در اين رابطه در فقه اماميه 4 نظريه مورد بحث قرار گرفته است. برخي از فقها قائل به توارث به طور مطلق هستند به اين صورت كه نكاح موقت را مانند نكاح دائم مي دانند و به عموم آيه 12 سوره نساء استناد مي كنند. گروه ديگر قائل به عدم توارث به طور مطلق هستند و بيان داشته اند ماهيت عقد موقت مقتضي توارث نمي باشد. ديگران قائل به تفصيل در مساله هستند كه دسته اي اصل را بر توارث دانسته و عدم توارث را فقط در صورت وجود شرط معتبر مي دانند و گروه ديگر اصل را عدم توارث مي دانند مگر اينكه شرط توارث شود.

The temporary marriage contract is one of the special rules of Jafary's jurisprudence that is different in some rules with permanent marriage. on of the rules that jurisprudence have discussed about it is discussion inheritance on temporary marriage. There are many disagreement in whether couples inherit each other on temporary contract or not, which this disagreement is due to the narratives that existence in this case. In this regard, in the jurisprudence of Imamiay, four theories are discussed. Some of the jurisprudence are absolutely believe in inheritance; in this way, they consider temporary marriage as permanent marriage and they cite the general verse 12 of the Nisa Surah. Other group are absolutely believe in non_inheritance and they have stated that the nature of the temporary marriage contract is not cover for inheritance. Others are believe in details of the issue which a group have considered the principle of inheritance only if there is a valid condition ; and the other group consider the principle non_inheritance unless the condition is inherited.
