تشهير اعلان مجازات مجرم و ندادادن به جرم او در برابر مردم است؛ بهويژه " تشهير " در جرايمي كه ممكن است به مجرم بهعنوان امين مردم اعتماد شود تا از اين داراي وجهۀ تنبيهي و « تشهير » . طريق وي را شناخته و از او دوري كنند سزادهي است و در دستۀ مجازاتهاي پذيرفته شده در موازين فقهي قرار ميگيرد. قانون مجازات اسلامي 1392 نخستين قانوني است كه به شكل گستردهاي اين كيفر را درباره گسترۀ وسيعي از جرايم مورد تصريح قرار داده است. ممكن است اين امر در غياب برخي نكات و شرايط به كارگيري اين كيفر، دربردارندۀ آثار منفي براي فرد و جامعه باشد. همچنين در اين قانون، به كيفر تشهير در قالب يكي از مجازات هاي اصلي تعزيري و در قالب مجازاتي تكميلي (در هر دو شق اختياري و الزامي آن) توجه شده كه در اين پژوهش به تفصيل مورد بحث و بررسي قرار گرفته است.
