Criminal Responsibility for Professional Private Institutions

به‌طور كلي اشخاص حقوقي را به دو دستة حقوق عمومي و خصوصي تقسيم كرده ­اند كه قانون مجازات اسلامي با توجه به آن، در مواد 20 و 143 تا حدودي به تشريح نحوه مجازات و مسئوليت كيفري اين اشخاص پرداخته است. اما در قوانين مربوطه به ماهيت و مسئوليت كيفري مؤسسات خصوصي حرفه ­اي اشاره ­اي نشده است، در حالي كه اين مؤسسات، شخصيتي مجزا از اشخاص حقوق عمومي و حقوق خصوصي دارند. بر اين مبنا، اين تحقيق با روش توصيفي- تحليلي ضمن پرداختن به ماهيت اين اشخاص، مسئوليت كيفري و نحوۀ اعمال هر يك از مجازات­هاي ماده 20 ق.م.ا مصوب 1392 را تشريح كرده است. در پايان اين نتيجه حاصل شد كه مؤسسات خصوصي حرفه­ اي ويژگي­ هاي هيچ يك از اشخاص حقوق عمومي و خصوصي را ندارند، بلكه حالت بينابيني دارند كه لازم است قانونگذار در موارد مأموريت عمومي آنها را از مجازات معاف و در ساير موارد، مجازات­ هاي قابل اعمال را مشخص نمايد.

Legal entities are divided into two categories: public and private. The Islamic Penal Code according to it, in materials 20 and 143 somewhat describes the punishment and the extent of their criminal responsibility, While these institutions have a distinct personality from government agencies and legal entities. On this basis, this research is descriptive-analytical and studies the nature of these persons, the criminal responsibility and how to apply each of the penalties in Article 20 of the Islamic Penal Code. At the end it was concluded that professional private institutions have not characteristics of government agencies and legal entities, rather, they are intermediary and they should be considered a new entity. Therefore, legislators should be exempt from punishment in cases of public mission, and in other cases specifying the penalties applicable is necessary.
