Legal Analysis of Economic Losses Due to Violation of the Invention and the Process of Its Valuation

تبيين مفهوم حقوقي ضرر اقتصادي ناظر بر نقض حق اختراع و روش ارزش‌گذاري ميزان نقض وارده از مهم‌ترين مباحث مطروحه در نظام حقوقي مالكيت فكري است كه تبيين آن مي‌تواند راهگشاي مشكلاتي از جمله تدارك معادل ريالي اختراع نقض‌شده در حوزۀ مسئوليت مدني يا تعيين ارزش آوردۀ فكري مخترع در شركت‌ها باشد. از منظر اقتصادي، توسعۀ اقتصادي، در گرو دسترسي به فناوري ارزشمند است، ازاين‌رو هرچه روش ارزش‌گذاري دقيق‌تر باشد، فرايند بهره‌برداري اقتصادي از اختراع پوياتر است. فرايند ارزش‌گذاري اختراع بسته به مرحلۀ گسترش آن متفاوت است، زيرا نياز بهره‌وران به اختراع در مراحل مختلف ايجاد، توسيع و تجاري‌سازي آن، منتج به افزايش يا كاهش ارزش عرفي آن اختراع مي‌گردد و اين مهم متعاقباً نياز به روشي متفاوت در ارزش‌گذاري اختراعات است. دستاورد اساسي اين مقاله در وهلۀ اول تقسيم اختراعات به سه دستۀ كلي از حيث ارزش مالي آنها و تبيين روش حمايت حقوقي از هر كدام و در مرحلۀ دوم ارائۀ معيارهاي دقيق ارزيابي آنها در صورت نقض و در مقام جبران خسارت مدني وارده است. ازاين‌رو در تحقيق حاضر كه تحقيقي كتابخانه‌اي با گرايش تحليلي- توصيفي است، بدواً مفهوم ضرر اقتصاديِ مرتبط با نقض حق اختراع و انواع نقض اين دسته اموال فكري بررسي و متعاقباً راهكار ارزش‌گذاري حق اختراع در مراحل مختلف آن از حيث حقوقي و اقتصادي بررسي خواهد شد.

The valuation of patent as an important part of intellectual property is one of the most important economic arguments in intellectual property rights and civil liability law that its explanation could lead to solving some problems such as compensating violated intellectual property. From the economical point of view, the country's economic development depends on access to technology. Therefore, the more precise the method of valuation, the economic exploitation of intellectual property is more dynamic. The process of technology valuation varies depending on the stage of its diffusion, since the demand of the technology for the various stages of its creation, dissemination and commercialization results in the increase or decrease of the conventional value of technology and consequently the need for a different method in its valuation. In the present research, after dividing the technology into three stages of the first technology, prototype technology and commercialization technology, the valuation methods of each one will be analyzed and it will be argued that the use of appropriate valuation methods will increase the accuracy in determining the value of the Relevant technology. The method of this research is based on a descriptive-analytic trend-based library approach. Information about the present study is compiled through the study of existing resources and after the study, necessary analyzes are presented in the form of legal thought.
