Analysis of the Mechanisms and Challenges of Software and Protocols Registration in the Field of »IoT«

اينترنت اشيا فناوري تعامل و ارتباط ميان ابزارها مي‌باشد كه در آن با تعبيۀ پروتكل‌‌‌ها و نرم‌افزارهاي طراحي‌شده بر پردازندۀ يك سخت‌افزار، امكان ارتباط اين ابزارها با يكديگر، عامل انساني و انجام وظايف تعيين شده فراهم مي‌گردد. براي آنكه نرم‌افزار يا پروتكلي قابليت ثبت داشته باشد، بايد از كاربرد عملي و خصوصيت نوآورانه نسبت به گونه‌‌‌‌هاي هم نوع خود برخوردار گردد. به جهت ماهيت و كيفيت طراحي پروتكل‌‌‌ها و نرم‌افزارهاي الكترونيك، طراحي موارد مذكور مخصوص به ابزاري هوشمند، هرچند نسبت به گونه‌‌‌‌هاي مشابه داراي هم‌پوشاني عملكردي باشد، به منزلۀ نقض حق معنوي دارندۀ اثر اوليه تلقي‌‌ نمي‌گردد. سازوكار ثبت اقلام بيان شده در نظام حقوقي آمريكا تحت دو مكانيسم اينترپارتس (درخواست جهت ثبت اقلام طراحي شده در صورت وجود شرايط قانوني) و پست گرنت (كيفيت رسيدگي به درخواست صورت گرفته و اعتراضات مدعيان نسبت به اقلام طراحي شده) صورت‌‌ مي‌گيرد.

IoT is a technology of interaction and communication between tools, whereby the embedded protocols and software on a hardware processor enable the communication of these tools with one another, the human agent and the assigned tasks. For software or protocol to be capable of being registered, it must have practical application and innovative properties relative to its species. Because of the nature and quality of the design of protocols and electronic software, the design of such cases for a smart instrument, although overlapping with similar variants, shall not be regarded as infringing the copyright of the original work. The mechanism for registering items stated in the US legal system is governed by two mechanisms: InterParts (request for registration of designated items if there are legal requirements) and Post-Grant (quality of claim processing and objections to designated items).
