مسؤوليت كيفري شركت‌هاي تجاري در مخاصمات مسلحانه داخلي (با تأكيد بر اقدامات شركت آمريكايي بلك‌واتر در عراق)

Criminal Liability of Commercial Companies in Internal Armed Conflicts (with Emphasis on the Actions of the American Company Blackwater in Iraq)

در سال­هاي اخير شاهد رشد چشم‌گير حضور بازيگران غيردولتي در عرصه‌­هاي مختلف بين ­المللي هستيم. شركت­هاي تجاري يكي از اين بازيگران غيردولتي هستند كه در عرصه ­هاي مختلف بين ­المللي به‌دنبال حضور گسترده و كسب سود مي­باشند. علي­رغم اينكه مخاصمات مسلحانه از يك‌سو براي غيرنظاميان و ساكنان مناطق جنگي فاجعه­ اي خانمان ­سوز محسوب مي ­شود، از سويي ديگر براي شركت‌هاي تجاري فعال در حوزه­ هاي نظامي و امنيتي، فرصتي براي حضور و كسب منافع بسيار زياد فراهم مي­كند. پس از سقوط دولت صدام در عراق، شركت‌هاي تجاري آمريكايي كه در عرصه­ هاي نظامي و امنيتي فعاليت داشتند، وارد عراق شدند و در طي سال­هاي ناآرام پس از جنگ، اقدام به فعاليت گسترده در حوزة نظامي و امنيتي كردند. يكي از اين شركت­ها، شركت بلك‌واتر است. فعاليت اين شركت معطوف به حوزه­ هاي امنيتي است. در طول انجام مأموريت بلك‌واتر چند حادثة مهم (ازجمله حادثة ميدان نسور و بحران وضعيت زندان ابوغريب) در عراق رخ داد. در پژوهش حاضر مسؤوليت­هاي كيفري ناشي از حوادث مزبور و وضعيت شخص حقوقي و اشخاص حقيقي درگير در اين حوادث از منظر حقوق بين­الملل كيفري مورد بحث قرار گرفته است.

In recent years, we have witnessed a significant increase in the presence of non-governmental actors in various international arenas. Commercial companies are one of these non-governmental actors that are looking for a large presence and profit in various international arenas. While armed conflict is, on the one hand, a catastrophic catastrophe for civilians and residents of war zones, on the other hand, it provides an opportunity for military and security companies to be present and gain enormous benefits. After the fall of Saddam's government in Iraq, American companies operating in the military and security fields entered Iraq and during the turbulent years after the war, began to operate extensively in the military and security fields. One of these companies is Blackwater. The activity of this company is focused on security areas. Several important incidents (including the Nasour Square incident and the Abu Ghraib prison crisis) occurred in Iraq during the Blackwater mission. In the present study, the criminal responsibilities arising from these incidents and the situation of the legal person and natural persons involved in these incidents from the perspective of international criminal law have been discussed.
