اصل كرامت انساني مهم‌ترين اصل مبنايي و پايه‌گذار نظام بين‌المللي حقوق بشر است كه حق‌هاي بشريِ شناسايي‌شده در نظام بين‌المللي حقوق بشر براساس آن توجيه‌پذير است. اين اصل، در اسناد حقوق بشري بين‌المللي و منطقه‌اي متعددي شناسايي شده است و حتي در اسناد مربوط به حقوق بشردوستانه نيز بر رعايت اين اصل و لزوم احترام به آن تأكيد شده است. يكي از مقولات بنيادين در انديشه معاصر، كرامت انسان است. نوشتار حاضر پس از اشاره‌اي گذرا به مفهوم كرامت انساني و تأمل در مباني آن در انديشه اسلامي، مي‌كوشد با استناد به آيات و روايات به نتايج و لوازم و مقتضيات آن در نظام اسلامي اشاره كند. يكي از وظايف مهم نظام اسلامي، ايجاد بستر مناسب براي بهره‌مندي انسان‌ها از همه ظرفيت‌هاي مادي و معنوي‌ است كه خداوند براي تأمين سعادت و تعالي آنان در وجود انسان و جهان آفرينش قرار داده‌ است. نمودِ ظاهري نظام اسلامي را مي‌توان در حاكميت ارزش‌هاي ديني و سبك زندگي اسلامي مبتني‌بر اعتقادات و دستورات اسلامي برگرفته از قرآن و سنّت مشاهده كرد كه در آن شهروندان جامعه اسلامي حق حيات طيبه، امنيت، آزادي‌هاي اجتماعي، رشد عقلانيت و دوري از جهل و خرافات، بهداشت جسمي و روحي، استقرار عدالت، گسترش اخلاق و فضايل انساني و رعايت شأن و حرمت انساني در پرتو مردم‌سالاري ديني دارند. البته كرامت انساني، مطلق نيست بلكه نسبي و تشكيكي است و براثر رفتارهاي اختياري ناشايست و سوء‌استفاده از استعدادها و فرصت‌هاي موجود، قابل سلب است و همين امر مجوز مشروعيت برخي مجازات‌هاي به ظاهر تحقيركننده يا دردناك و متناسب با جرم ارتكابي است.
