حمايت دستوري از محيط زيست ناظر به ماهيت، مولفه ها و چگونگي حفاظت از محيط زيست در حقوق اساسي است. نظريه عمومي دستورگرايي زيست محيطي مبتني بر اين انگاره است كه با ورود مسيله محيط زيست و ضرورت حمايت و حفاظت از آن در قانون اساسي به عنوان هنجار مرجع، شاهد اساسي سازي نظم حقوقي در اين زمينه خواهيم بود. در اين مقاله سعي شده است با رويكرد تطبيقي و براي نمونه به تحليل محتواي قوانين اساسي حوزه آمريكاي لاتين در توجه به مسايل مربوط به محيط زيست و حفظ منابع طبيعي پرداخته شود. فرضيه اساسي اين مقاله بر اين مبنا استوار است كه امروزه توجه به مسيله محيط زيست در سطح قوانين اساسي به معناي تبعيت هنجارهاي مادون و نظام حقوقي از هنجار مرجع و آثاري است كه اين حق مي تواند در نظام حقوقي به همراه داشته باشد. امري كه در قوانين اساسي حوزه آمريكاي لاتين به نحو مطلوبي منعكس گرديده است.
