اجتهاد تمدني؛ منطق فهم دين در مقياس تمدن‌سازانه چيستي، امكان و چگونگي

Civilization Ijtihad The Logic of Understanding Religion on a Civilizing Scale

هدف نگارنده در اين مقاله، دستيابي به روشي استنباطي مبتني‌بر مكتب اجتهاد جواهري، براي اكتشاف نظر شارع دربارۀ ساختارها و فرايندهاي لازم در تحقق يك تمدن است. در اين مقاله، پس از مفهوم‌‌شناسي «تمدن» و «اجتهاد»، به چيستي اجتهاد تمدني پرداخته شده است كه دال مركزي آن «استنباط فرايندها» از ادله است و تمايز آن با عناوين مشابهي مانند فقه حكومتي و فقه نظام ارائه شده است. سپس با استفاده از تعميم متعلَّق حكم از «فعل جوارحي مكلف فردي» به «كليۀ فعل‌‌ و انفعالات و تغييرات حاصل از ساختارها و فرايندها» و تعميم كاركرد «حجيت» از «مُعذّريّت و مُنجّزيت» به «مَدركيت»، اثبات شده است كه اجتهاد به فقه موجود اختصاص ندارد و مي‌‌تواند فهم از گزاره‌‌هاي توصيفي و اخلاقي را هم در مقياس خرد و هم مقياس كلان مديريت كند. در انتهاي مقاله نيز به چگونگي اجتهاد تمدني، با استفاده از ابزار «وضع الفاظ براي ارواح معاني» و ابزار «منطق سيستم‌‌ها» در جمع ميان ادله پرداخته شده و نمونه‌‌‌‌اي از اين عمليات نيز ارائه شده است.

The aim of this article is to achieve an inferential method based on the school of “Javaheri” ijtihad, to explore the Shari'a view of the structures and processes necessary for the realization of a civilization. In this article, after the semantics of "civilization" and "ijtihad", what is civilized ijtihad, the central sign of which is "inference of processes" from evidence, and its distinction with similar topics such as government jurisprudence and system jurisprudence is presented. Is. Then, by using the generalization of the sentence, from "individual obligatory action verb" to "all interactions and changes resulting from structures and processes", and the generalization of the function of "authority" from "excuse" to "evidence" has been proved. Ijtihad is not dedicated to existing jurisprudence and can manage the understanding of descriptive and moral propositions both on a micro and macro scale. At the end of the article, the method of civilized ijtihad, using the tools of "setting words for the spirits of meanings" and the tool of "logic of systems" among the evidence, is discussed and an example of this operation is provided.
