چكيده فارسي :
انسان حق تعيين سرنوشت خويش را دارد و تنها او بر حقوق مالي خويش مسلط است. نظم و انضباط اجتماعي نيز در جامعه ايجاب مي‌كند كه حقوق مالي اشخاص از ثبات نسبي برخوردار باشد و در معرض تزلزل و تشويش ناشي از مداخلۀ ديگران قرار داده نشود. به موجب اصل عدم مداخله، امكان دخالت در حقوق مالي بدون ارادۀ صاحب حق مالي وجود ندارد.
اعتبار اين اصل ازطريق پاره‌اي از اصول مبنايي نظير اصل كرامت، برابري و آزادي انسان‌ها و حق تعيين سرنوشت قابل اثبات است. به موجب اصل نخست، خداوند با بخشيدن نعمت تعقل و برتري‌دادن انسان بر ساير مخلوقات، انسان را تكريم كرده است و براساس اصل دوم، انسان‌ها در ذات و خلقت با يكديگر برابرند و هيچ موجبي براي تقدم برخي از انسان‌ها وجود ندارد؛ از منظر اصل سوم، آزادي انسان ايجاب مي‌كند كه آزادنه و خلّاقانه تصميم بگيرد و تصميم‌گيرندۀ خارجي نقشي در تحميل اراده به وي نداشته باشد و در آخر تعيين سرنوشت حق هر انساني است كه با ارادۀ خويش مي‌تواند آن را تعيين كند. در اين مقاله نويسنده از طريق تحليل محتوايي و توصيفي، ضمن معرفي اصل عدم مداخله در حقوق مالي ديگري، مباني آن را تبيين كرده است.
چكيده لاتين :
Man has the right to determine his own destiny and he alone is in control of his financial rights. Social order in society causes the financial rights of individuals to be relatively stable and not to be exposed to instability due to the intervention of others. According to the principle of non-interference, it is not possible to interfere in financial rights without the will of the owner of the financial right.
The validity of this principle through some basic principles such as; The principle of dignity, equality and freedom of human beings and the right to self-determination can be proved; According to the first principle, God has honored man by giving him the blessing of reason and giving man superiority over other creatures. According to the second principle, human beings are equal in nature and creation, and there is no reason for some human beings to take precedence. From the perspective of the third principle, human freedom requires that one decide freely and creatively and that the external decision-maker has no role in imposing his will on him and in the end, determining the destiny is the right of every human being who can determine it by his own will. In this article, the author has explained its principles through content and descriptive analysis, while introducing the principle of non-interference in other financial rights.
