Bioethics Methodology in the Islamic Legal System

روش‌شناسي اخلاق زيستي اسلامي عهده‌دارِ تبيين منطق و چارچوبِِ استخراج قواعد رفتاري حوزه زيستي است. اين منطق و چارچوب كه متناسب با اراده‌گرايي حكيمانه است، در موارد ذيل به كار مي‌آيد: شناخت مسئله، موضوع و رجوع به منابع و ادلۀ معتبر. در اين نوشتار، روش‌شناسي اخلاق زيستي اسلامي، در سه بخش سامان‌دهي شده است؛ «روش شناسايي حل مسئله»، «موضوع‌شناسي» و «حكم‌شناسي». در بخش مسئله‌شناسي مشخص خواهد شد «شناخت مسئله» با توجه به شرايط محيطي به ويژه مباني فكريِ محيط شكل‌گيري، با «حل مسئله» متفاوت است. محقق هنگام مواجهه با هر مسئله بايد مشخص سازد از اساس مسئله‌اي وجود دارد يا وجود مسئله، توهم شده يا مختص محيط ديگري بوده است؛ بر فرض وجود، سنخ آن چيست؛ تا در مراحل بعد بتوان روشن ساخت با توجه به سنخ مسئله، روش‌شناسيِ پاسخ به آن چيست. در بخش حكم‌شناسي نيز، سنخ قواعد مورد نياز در اين حوزه بر اساس سنخِ مسائلِ آن تبيين شده است؛ از جمله: مصالح معتبر، سياست‌ها و قواعد كلي.

The methodology of Islamic bioethics explains the logic and framework to understand the problem, subject and referring from the sources and valid evidence with the aim of extracting bio-field behavior rules in accordance with the rational command theory. The methodology of Islamic bioethics is organized here based on three part of problem-solving, understanding the subject matter and inferring the rule. In the part of understanding the problem I will explain that recognizing the problem has different aspects. Due to environmental conditions, especially to the theoretical environment around the formation and problem solving context when faced with any problem, the researcher should determine that is there any real problem or there is an illusion or the problem is specific to another environment. an‎d also on the assumption that the problem exists what sort of problem it is and based on the answer what is the methodology for solving the problem. In the rule inferring part I discuss the sort of inferring methods and institutions including authentic expedients, policies and general rules.
