حق بر آب در نظام بين المللي حقوق بشر

آب عنصري ضروري براي زندگي است.توسعه اجتماعي و اقتصادي يكسره به آب گره خورده است.حقوق بشر و منابع آب از جمله مهم ترين مسائل مورد توجه جامعه جهاني در سال هاي اخير بوده است.بسياري از كنفرانس ها و مجامع برگزار شد و قطعنامه و اعلاميه هايي از جانب آن ها به تصويب رسيد. حق دسترسي بشر به آب از دهه 1970 در دستور كار جامعه جهاني بوده است.اما همواره بين اعلام آب به عنوان نياز اساسي بشر و يا مثابه حقي از حقوق بشر ترديد وجود داشت. امروزه حقي تحت عنوان حق دسترسي بشر به آب در چارچوب حقوق بين الملل وجود دارد و اين حق در اسناد بين المللي به طور صريح و ضمني مورد اشاره قرار گرفته است. نظريه شماره 15، آشكارترين و صريح ترين مورد شناسايي حق دسترسي بشر به آب در حقوق بين الملل است. اما در عين حال،حق برآب با نسل هاي مختف بشري در ارتباط است . حق ‌بر‌آب با بسياري ديگر از حقوق بشر از جمله؛ حق سلامت،حق غذا ،حق تعيين سرنوشت ، حق بر آموزش، حق بر كار از جمله كشاورزي،حق بر بهداشت، حق بر محيط زيست،حق بر صلح،حق بر توسعه و...ارتباط دارد.و در صورتي كه حق بر آب با چالش مواجه شود اين حقوق نيز در اجرا با چالش اساسي روبرو خواهند شد و ميزان تحقق آن در هاله اي از ابهام قرار خواهد گرفت. هر چند در نظام حقوقي ايران هيچ مقرره صريحي درخصوص حق بر آب آشاميدني سالم وجود ندارد اما از عمومات مواد مندرج در قوانين مختلف مي توان نتيجه گرفت كه دولت موظف به تأمين آب آشاميدني و حفظ سلامت آب است.
