مسئوليت مدني محيط بانان وجنگلبانان

محيط زيست و جنگل‌ها ازجمله‌ مهم‌ترين نعمت‌هاي خدادادي‌اند كه حفاظت از آنها به دغدغۀ مهمي در سراسر دنيا تبديل و براي جلوگيري از نابودي آنها مقررات زيادي وضع شده است. به موجب همين مقررات، محيط‌بانان و جنگل‌بانان مأموريت دارندكه از اين عرصه‌ها نگهداري و از نابودي آنها جلوگيري كنند.اين افراد درراستاي انجاماين مأموريتاختياراتي نيز دارند كه دو مورد از مهم‌ترين آنها عبارت است از اينكه اگر آموزش‌هاي لازم را ببينند ضابط دادگستري شمردهمي‌شوند، و ديگر اينكهحق دارند هنگام كار، اسلحه حمل كنند. گاهي همين افراد موجب خسارت به اطراف خود مي‌شوند كه دراين صورت بر مبناي نظريۀ تقصير،مسئول هستند وبا توجه به اين امر كه محيط‌بانان و جنگل‌بانان كارمند دولت به شمارمي‌آيند‌، با استناد به قانون مسئوليت مدني،اگر به عمد يا در اثر بي‌احتياطي به مناسبت انجام وظيفه خسارتي را وارد كنند، خود مسئول جبران اين خسارت هستندو فقطدر صورتي اداره مسئول است كه ايجاد خسارت‌، ناشي از نقص وسايل آن اداره باشد.
