Civil liability of general perpetrators (police) in violation of human rights requirements

ضابطان در اجراي تكاليف خود تابع اصولي هستند كه تخطي از آن داراي ضمانت اجراي كيفري و مدني است. اصول پيشرفتة حقوق بشر به‌عنوان راهنماي ضروري ضابطان داراي داده‌هاي متعددي براي حفظ كرامت اشخاصي است كه مخاطب نظام عدالت كيفري تلقي مي‌گردند. با توجه به اينكه ضابطان در انجام رسالت‌هاي خود، عمدي و يا سهوي اقدام به نقض اصول حقوق بشري مي‌‌كنند و با توجه به اينكه تعيين خسارت براي مأموران چه در صورت اثبات تقصير و چه در فرض تخطي هم در مقررات ايران و هم در فرانسه جانمايي شده است؛ بنابراين، شناخت ابعاد مسئوليت مدنيِ اين موضوع مي‌تواند موجب ارتقاي آموزه‌هاي پليس و ديگر مأموران شود.

Officers are subject to the principles in the implementation of their duties, the violation of which has a guarantee of criminal and civil enforcement. The basic principles of human rights, as a necessary guide for officers, have a wide range of data to protect the dignity of those who are considered to be the target of the criminal justice system. Considering that the officers intentionally or inadvertently violate the principles of human rights in carrying out their missions, and considering that the determination of damages for the officers, both in case of proving guilt and in case of violation, is included in both Iranian and French regulations. Therefore, recognizing the dimensions of civil liability in this case can lead to the promotion of the teachings of the police and other officers
