پليس و رعايت حقوق شهروندي متهمان (مورد مطالعه: فرماندهي انتظامي غرب تهران)

Police respect people's rights and the defendants (Case of West Tehran police commander)

رعايت حقوق شهروندي از طرف كليه مجامع بين‌المللي و داخلي مورد تأكيد است و سال هاي اخير نيز توجه زيادي به خود معطوف كرده، از طرفي امروزه آزادي و امنيت يكي از اساسي ترين حقوق براي شهروندان محسوب مي شود، بنابراين تأمين اين دو مقوله دغدغه اصلي حكومت ها است. پليس كه يكي از نهادهاي اصلي حفظ نظم و امنيت در جامعه است ممكن است در راستاي انجام وظايف خود آزادي هاي شهروندان را محدود كرده يا آن را نقض كند. به عبارت ديگر پليس براي انجام وظايف مختلف از جمله برقراري نظم و امنيت در جامعه ناگزير از اعمالي هستند كه شايد منجر به نقض حقوق شهروندان شود. در پژوهش حاضر مسئله اين است كه پليس غرب استان تهران تا چه ميزان حقوق شهروندي متهمان را در فرآيند دادرسي كيفري( مرحله هاي كشف، تعقيب جرايم، تحقيق و مرحله اجراي احكام كيفري) رعايت مي‌كند؛ بنابراين با توجه به ماهيت موضوع و اهداف تحقيق، پژوهش حاضر با استفاده از روش توصيفي پيمايشي و ابزار پرسش‌نامه و انتخاب نمونه 373 نفر( بر اساس جدول مورگان) از جامعه آماري تعداد 10674 متهم دستگير شده توسط پليس غرب استان استفاده شد. اطلاعات جمع آوري شده با آزمون تي نمونه اول مورد بررسي قرار گرفت كه خروجي آزمون حاكيست پليس غرب استان تهران در حد خوبي حقوق شهروندي متهمان را در مرحله كشف و تعقيب جرايم رعايت مي‌كند، ليكن در جريان تحقيق ( بازجوئي) حقوق شهروندي متهمان مراعات نمي شود؛ اما حقوق شهروندي متهمان در مرحله اجراي احكام به‌طور كامل رعايت مي‌شود.

The observe of citizenship rights has been emphasized by the international communities and civils and in the recent years it have drawn much attention to itself, on the other hand, today liberty and security is one of the fundamental rights of the Citizens' Rights, thus providing these two things is the government's main concern. The Police which is one of the main institutions to maintain the order and security in the society may be restricted or violated their civil liberties in order to perform its duteis. In other words the police have to do various tasks and actions including establishment of order and security in society that may lead to violations of citizens' rights. In this research there is a question and that is what extent civil rights accused in the West of Tehran police in the criminal process (stages of discovery, crime prosecution, research and the implementation of sentences) will follow? Considering the nature and aims of the research, in this study has been used a descriptive method and questionnaire as a sample of 373 people (according to Morgan) the population of 10674 accused arrested by the police in West Tehran on 1395 / 1/1 till 1395/ 2/31. The collected data were analyzed by t-test specimens which the output of the test says that West police in Tehran has observe properly the citizenship rights of defendants In the discovery and prosecution of crimes But during the investigation (interrogation) does not observed the civil rights of the accused but civil rights of the accused in the execution orders are fully observed.
