ثبت مجرمان جنسي؛ آگاه‌سازي جامعه و برخي تأملات نسبت به حريم خصوصي

The sex offender register, community notification and some reflections on privacy

يكي از دغدغه‌هاي اساسي سياست‌گذاران در قلمرو كنترل بزهكاري، چگونگي مديريت مجرمان خطرناك در سطح جامعه است. ثبت اطلاعات مجرمان خطرناك از سوي دستگاه پليسي و ساير مراجع، ابزاري مهم در جهت ادارۀ اين مجرمان و حفاظت جامعه در مقابل آن‌ها است. با وجود سابقه طولاني ثبت در برخي ايالات آمريكا، كشور انگلستان از اواسط دهۀ نود، با بهره‌گيري از تجارب ثبت در كشور آمريكا، و با تصويب قوانين متعدد، اقدام به طراحي سامانۀ ثبت مجرمان خطرناك جنسي كرد. نوشتار حاضر ضمن اشاره به خاستگاه ثبت مجرمان خطرناك جنسي و بررسي قوانين موضوع در زمينه ثبت مجرمان جنسي در انگلستان و سير تحول اين قوانين از سال 1997 ميلادي تا به حال، به‌دنبال پاسخ به سؤال‌ها و ابهام‌هاي مطرح در اين حوزه است. سؤالاتي نظير اين‌كه: آيا ثبت در كنترل و پيش‌گيري از تكرار جرم مجرمان خطرناك جنسي تأثيري دارد؟ آيا ثبت و افشاي اطلاعات مجرمان خطرناك، سبب بروز چالش‌هاي حقوقي از جمله موجب نقض حريم خصوصي افراد نخواهد شد؟ آيا براي حفاظت جامعه ضرورتي به اِعلام اطلاعات مجرمان خطرناك به مردم وجود دارد؟ افزون بر اين، واكنش پليس نسبت به سياست آگاه‌سازي افراد جامعه از موضوع‌هاي مهم مورد بحث در مقاله حاضر است. مهم‌ترين دليل انتخاب متن حاضر جهت ترجمه، استفاده از تجربيات پليسي، قضايي و قانون‌گذاري ساير كشورها در امر مديريت و كنترل مجرمان خطرناك است. اين نوشتار كه ناظر به يكي از ابزارهاي مديريت مجرمان است نه تنها مي‌تواند براي تدوين قوانين كارآمد جهت كنترل مجرمان جنسي در ايران قابل استفاده باشد، بلكه مي‌توان از تجارب حاصل از ثبت مجرمان جنسي، نسبت به ساير مجرمان خطرناك نيز در كشورمان بهره گرفت.

One of the main concerns of policymakers in the area of crime control is how to manage dangerous criminals at the community level. The registration of dangerous offenders by the police and other authorities is an important tool for managing these criminals and protecting the community against them. Despite the long record of registration in some states in the United States, since the mid-1990s, the United Kingdom has been using registration practices in the United States, and has enacted a number of hazardous sex offender registries with numerous laws. The present article, while referring to the origins of the registration of dangerous sex offenders and the review of the law on the registration of sexual offenders in the United Kingdom, and the evolution of these laws, have since sought to answer the questions and ambiguities in this area. Questions like: Does registration record control and prevent repeat offending offenders? Does the registration and disclosure of dangerous criminals' information does not lead to legal challenges such as violating privacy? Is there a need to inform the criminals of dangerous criminals to protect the community? In addition, the police response to the policy of informing the community is one of the important issues discussed in the article. The most important reason for choosing the text for translation is the use of police, judicial and other jurisdictions in the management and control of dangerous criminals. This article, which is considered as one of the tools for managing criminals, can not only be used to formulate effective rules for controlling sexual offenders in Iran, but also can be used to capture the experiences of sexual offenders from other criminals in our count.
