چكيده فارسي :
عدالت ترميمي الگويي نو در نظام عدالت كيفري است. عدالت ترميمي از دهه هفتاد قرن بيستم مورد توجه قرارگرفته است. اين الگو به عنوان راه حل منازعات ناشي از ارتكاب جرم و ترميم صدمات و خسارات وارده بر بزه ديده مورد توجه قرار گرفت. از نظر انديشمندان علل گرايش به عدالت ترميمي ناتواني عدالت سيتم كيفري سنتي يا كلاسيك مي‌باشد. مشكلات ومسائلي كه از اجراي عدالت كيفري سنتي (عدالت كيفري مبتني بر سزا دهي و بازپروري مي‌باشد كه در آن سزا دهنده ناظر بر جرم بوده و عدالت باز پرورانه بر بزهكار توجه دارد) و عدم توجه كافي به حقوق و جايگاه بزه ديدگان و بطوركلي مصادره عدالت از طرف دولت و ايرادها و انتفادهاي وارد بر آن زمينه‌ساز ظهور عدالت ترميمي و استفاده از برنامه‌ها و روش‌هاي اجراي آن در بسياري ازكشورهاي جهان گرديد. تلاش‌هاي ملي براي اجراي برنامه‌هاي عدالت ترميمي به سرعت در نهادهاي منطقه‌اي و بعد از آن در قلمروي بين المللي توسط سازمان ملل مورد توجه قرار گرفت.
چكيده لاتين :
Reconciliation is a new model in the criminal justice system. Reconciliation from the seventies of the twentieth century has been considered. This model was considered as a solution to the conflicts caused by committing crime and repairing the injuries and damage inflicted on the victim. According to the scholars, the causes of the tendency towards restorative justice are the inability of the justice system to be traditional or classical.
Problems and problems related to the implementation of traditional criminal justice (criminal justice based on reprisal and criminal justice, in which the crime is cruel and justice is open to justice), and the lack of attention to the rights and property of the victims and the general seizure of justice The government's side and the use of the proceeds of this process have created the basis for the emergence of restorative justice and the use of programs and methods of implementation in a number of countries around the world. National efforts to implement restoration justice programs were quickly addressed by the United Nations in regional institutions and subsequently within the international realm.
