تحولات آيين دادرسي كيفري در حقوق بازداشت متهمين

Changes in the criminal procedure in the rights of detainees

قانون آيين دادرسي كيفري 1392 با تأثيرپذيري از الگوي جهاني دادرسي عادلانه و استفاده از مطالعات تطبيقي با اتخاذ رويكردهاي نوين از نظام دادرسي تفتيشي در مرحله تحقيقات مقدماتي فاصله گرفته است. ضرورت رعايت اصل دادرسي عادلانه و منصفانه ايجاب مي‌نمايد كه حقوق دفاعي متهم در فرآيند دادرسي كيفري رعايت گردد و الزاماتي از اين حيث براي ضابطين و مقامات قضايي مقرر گردد تا با تفسيرهاي سليقه‌اي حقوق متهم پايمال نگردد. در راستاي همين ضرورت‌ها قانون‌گذار در تصويب قانون آيين دادرسي كيفري به حقوق دفاعي متهم بيشتر توجه نموده و قانون در اين زمينه داراي تحولات و نوآوري‌هاي مثبتي مي‌باشد. نتايج اين تحقيق حاكي از اين است كه قانون نسبت به قوانين نسخ شده قبلي داراي پيشرفت در زمينه حقوق متهم به‌ ويژه در بحث مربوط به بازداشت متهمين بوده و موارد جديدي در اين زمينه از جمله جبران خسارت به حقوق متهم اضافه نموده است.

The Criminal Procedure Code of 1392 has been interfered with the impact of the universal model of fair trial and the use of comparative studies by adopting new approaches to the audit process in the preparatory phase of the preliminary investigation. The necessity of observing the principle of a fair and just trial requires that the defendant's defense rights be observed in the criminal procedure and that the requirements for such an offense and judicial authority be imposed in order not to be overcome by the interpretations of the rights of the accused. In line with this necessity, the legislator will pay more attention to the defendant's defense rights in adopting the Criminal Procedure Law, and the law has positive developments and innovations in this regard. The results of the study indicate that the law has improved the rights of the accused, especially in the context of the arrest of the defendants, and added new cases in this regard, including compensation to the defendant's rights.
