تحولات حوزه مسئوليت مدني وحمايت از زيانديدگان حوادث رانندگي و نقش پليس در پيشگيري از حوادث رانندگي در پرتو "قانون جديد بيمه مصوب1395"

گستره حـوادث رانندگي در ميان مردم نگراني فراگيري را موجب شـده است، بهترين راه مقابله با آن برنامه هاي پيشـگيري و كاهش اين حـوادث اسـت؛ در عين حالي كه حاكميت نبايد نسبت به حمايت از قربانيان اين حوادث بي تفاوت باشد. جبران ضرر و زيان وارده،حداقل انتظار زيانديده گان اين حوادث اسـت. با توجه به نقش اساسي اتومبيل در زندگي كنوني و تعداد فراوان حوادث رانندگي و به تبع آن زيان هـاي مـالي و بدني ناشي از آن ها، همچنان مسئوليت ناشي از حوادث رانندگي يكي از مهمترين مباحث مسئوليت مدني و دعاوي ناشي از آن را تشكيل ميدهد از همين روي قانون گذاران بسياري از كشورها، به وضع و تصويب قوانيني خـاص در خصوص تعيين و تبيين مسئوليت ناشي از حوادث رانندگي با هدف توسعه حمايت از زيان ديـدگان حـوادث رانندگي و تسريع و تسهيل جبران زيان قربانيان اينگونه حوادث اقدام نموده اند. در كشور ما نخستين بار در سال 1347 ،قانون بيمه مسئوليت مدني دارندگان وسايل نقليه موتوري زميني در مقابل شخص ثالث به تصويب رسـيد با وجود اين، گذشت بيش از 40 سال از تصويب اين قانون و عدم تناسـب آن بـا مقتضـيات زمـاني و مكـاني و نيازهاي حقوقي و اجتماعي و اقتصادي موجب شد تا مقنن با تصويب قانون اصلاح قانون بيمه مسـئوليت مـدني دارندگان وسايل نقليه موتوري زميني در مقابل شخص ثالث در سال 1387 ،گامهايي مهم و اساسي در حوزه بيمه مسئوليت مدني با توسعه حمايت از زيان ديدگان حوادث رانندگي بردارد .اما اين قانون نيز نواقص و ابهامات زيادي را داشت كه نهايتا با تصويب قانون جديد بيمه شحص ثالث در سال 95 افق جديدي به خصوص در بحث حمايت از زيانديده گان حوادث رانندگي باز شد، از طرفي در اين قانون نقش پليس نيز پر رنگ تر از قوانين سابق به چشم مي‌رسد و موارد و مسئوليت هايي كه در حوزه پليس بيان شده مي‌تواند در كاهش حوادث و تصادفات تاثير گذار باشد كه در اين مقاله به آنها مي پردازيم.

In our country, for the first time in 1347, the Civil Liability Insurance Law of Land Motor Vehicle Owners was passed against a third party. and socially and economically, the legislature took important steps in the field of civil liability insurance by adopting the Law on Amending the Law on Insurance Responsibility of Land Motor Vehicle Owners Against a Third Party in 2008, by developing support for victims of traffic accidents. The law also had many shortcomings and shortcomings, which were eventually approved by the law Third party insurance opened a new horizon in 1995, especially in the protection of victims of traffic accidents. 151 On the other hand, in this law, the role of the police is more colorful than the previous laws and the cases and responsibilities expressed in the field of police. It can be effective in reducing accidents and incidents, which we will discuss in this article.
