چكيده فارسي :
در يك سال گذشته حدود 300 هزار مراجعه به دواير مددكاري صورت گرفته كه از اين بين 70 تا 80 درصد از پرونده‌هاي مراجعان با مصالحه از چرخة ارجاع به دادگاه خارج شده‌اند كه 70 درصد از مراجعات ناشي از اختلافات خانوادگي و مابقي نزاع همسايگان، درگيري‌هاي محيطي و دختران فراري است لذا با توجه به موارد گفته شده هدف اين تحقيق ارزيابي اثربخشي ميانجي‌گري كلانتري‌ها در كاهش تشكيل پرونده‌هاي قضايي است.
روش‌شناسي: روش تحقيق در اين پژوهش در بخش مفاهيم، تاريخچه و مباني نظري، بر پايه مطالعات كتابخانه‌اي استوار بوده و در بخش تحقيقات ميداني، با استفاده تجزيه و تحليل پاسخ پرسش‌نامه‌اي و بررسي اسنادي كه از طريق سوابق موجود در سطح يگان‌هاي 110 و دواير مشاوره و مددكاري اجتماعي تعدادي از كلانتري‌هاي تهران (مورد مطالعه سركلانتري‌هاي سوم و هفتم فاتب) و همچنين مرفوك پليس تهران صورت گرفته است.
يافته‌ها و نتيجه‌گيري: اعمال فرايند ميانجي‌گري در كلانتري‌ها مي‌تواند به‌نحو چشمگيري منجر به كاهش تشكيل پرونده‌هاي قضايي گردد كه اين امر موجب بروز نياز به فرايند مذكور گرديده است؛ بنابراين مسئولان و متوليان امر در حوزة ناجا و دستگاه قضايي با اتخاذ تصميم و تدبير مناسب در راستاي بهينه‌سازي فرايند ميانجي‌گري و تقويت عوامل مؤثر بر آن اهتمام ورزيده و مقدمات اجراي آن را فراهم كنند. با توجه به اينكه نياز به ميانجي‌گري در دعاوي نيازي مثبت و آثار اجرايي‌شدن آن در سازمان احساس مي‌گردد جا دارد با همت و مدد مسئولان و با سياست‌گذاري‌هاي مناسب، راه‌هاي حصول به اين نياز و مرتفع‌كردن موانع آن را احصاء و قدم‌هاي مؤثري در تقويت اعمال فرايند ميانجي‌گري در كلانتري‌ها برداشته شود. نتيجه اينكه قوانين موضوعه يا حمايت قانوني از ميانجي‌گري بيش از متوسط، برآورد مي‌گردد؛ به عبارت ديگر با اطمينان 95 درصد تأثير به‌كارگيري ميانجي‌گري در كلانتري‌هاي دو سركلانتري سوم و هفتم فاتب از حمايت قانوني مناسبي بيش از متوسط و در سطح زياد ارزيابي مي‌گردد. از طرفي آشنايي كاركنان كلانتري‌ها به قوانين و مقررات ميانجي‌گري بيش از متوسط و در سطح مطلوبي ارزيابي مي‌گردد. همچنين ميزان تأثير ميزان معاضدت و حمايت مقامات قضايي از ميانجي‌گري كلانتري‌ها در سركلانتري‌هاي سوم و هفتم فاتب بيش از متوسط و در سطح زياد ارزيابي مي‌گردد.
چكيده لاتين :
In the past year, about 300,000 referrals have been made to the help circles, of which 70 to 80% of the clients' cases have been removed from the referral cycle by conciliation. He said that 70% of the referrals were due to family disputes and specified: neighbors' conflicts, environmental conflicts and runaway girls are the other issues that are raised in aid work. (Hamidifar, 1396).
Method:
The research method in this research in the concepts, history, and theoretical foundations section is based on library studies and in the field research section, using the analysis of questionnaire responses and reviewing documents through records at the level of 110 units and A number of counseling and social work departments have been set up in a number of Tehran police stations (studied by the third and seventh Fateb police stations) as well as in Marfouk, Tehran police.
findings:
Applying the mediation process in police stations can significantly reduce the number of court cases, which has led to the need for this process. Therefore, the officials and custodians in the field of NAJA and the judicial system should take appropriate decisions and measures in order to optimize the mediation process and strengthen the factors affecting it and prepare for its implementation. Given that the need for mediation in positive needs cases and the effects of its implementation is felt in the organization, it is appropriate to count the ways to achieve this need and remove obstacles to it, and effective steps, with the efforts and assistance of officials and appropriate policies. In strengthening the enforcement of the mediation process in the police stations should be removed.
Results:
Subject matter or legal protection of mediation is estimated to be above average. In other words, with 95% confidence, the effect of using mediation in the police stations of the third and seventh Fateb police stations of appropriate legal protection is evaluated above average and at a high level.
On the other hand, the familiarity of police officers with the rules and regulations of mediation is assessed as above average and at a desirable level.
Also, the effect of the level of assistance and support of judicial authorities from the mediation of police stations in the third and seventh police stations of Fateb is assessed as above average and at a high level.
