The effects of dual citizenship and ways to prevent it

مطابق قرارداد لاهه از سال 1930 اصولي در خصوص تابعيت در كشورها رعايت ميشود كه عبارتند از: اصل لزوم تابعيت اصل تابعيت واحده و اصل تغيير پذيري تابعيت. اما علي رغم سعي و كوششي كه در سطح داخلي كشورها و در سطح بين المللي جهت رعايت اين اصول صورت گرفته است گاهي با افرادي روبرو مي شويم كه بي تابعيت [4] مي باشند يا بيش از يك تابعيت [5] دارند. به عقيده ي برخي از حقوقدانان فرانسوي مثل هانري باتيفول [6] بي تابعيتي در اثر تعارض منفي [7] تابعيت و تابعيت مضاعف در اثر تعارض مثبت [8] تابعيت به وجود مي ايد. حال با ظهور كشورهاي مختلف در عرصه بين المللي و اختلاف نظام حقوقي حاكم بر آنها و قوانين سيستم هاي مختلف اعطاي تابعيت در هركشور و روابط حقوقي با اشخاص يكديگر و با دول متبوع خود موجب پديدار شدن تابعيت مضاعف در مواردي براي اشخاص گرديده است.

According to the Hague Agreement, since 1930, the principles of nationality are respected in the countries: the principle of the necessity of the citizenship of the principle of the citizenship of the unit and the principle of the nationality of citizenship. Now, with the emergence of different countries in the international arena and the differences between the legal system governing them and the rules of the various systems of granting citizenship in each country, and legal relations with individuals and with their respective governments, it has become more dual citizenship in some cases for the people.
