نقش و جايگاه ضابطين دادگستري در بازجويي از افراد در نظام كيفري ايران و آمريكا

استنطاق يا بازجويي بي‌شك يكي از مهم‌ترين مراحل تحقيقات مقدماتي است و ضابطين دادگستري به‌ويژه مأمورين پليس در بدايت تشكيل پرونده قضايي نخستين سنگ بناي دادرسي كيفري را بازجويي مستحكم مي‌نمايند، تدوين و اجراي قوانين در اين حوزه مي‌تواند مصونيت افراد را از خود اتهامي و عدم تضييع حقوق آن‌ها در برهه‌اي كه فشار رواني بالايي بر فرد تحميل مي‌گردد به همراه داشته باشد قانون‌گذار ايران در سال 92 با تغييراتي كه در قوانين بازجويي قانون آيين دادرسي كيفري داشت، تلاش نمود تا از حقوق افراد نزد ضابطين دادگستري دفاع نمايد، قياس حقوق افراد در دوران بازجويي با ديگر كشورهاي جهان به‌طور اخص با كشور ايالات‌متحده آمريكا كه حقوق افراد در زمان بازجويي را در حدود نيم‌قرن پيش به رسميت شناخته است، مي‌تواند شناخت بيشتري را در ذهن نسبت به ميزان توجه قانون‌گذار ايران فراهم نمايد در اين پژوهش سعي شده است مطالعه تطبيقي حقوق دوران بازجويي نزد پليس در نظام كيفري ايران و آمريكا انجام و ميزان تضمين حقوق افراد در فرآيند بازجويي در قانون ايران روشن‌تر گردد.
