پوشش در تمدن هاي بشري همواره نشان دهنده فرهنگ، علايق و سليقه هاي مردم جوامع بوده است. اين امر كه پوشش جزيي از فرهنگ ملت هاست به روشني در موزه هاي مردم شناسي قابل مشاهده است . امروزه با تحول جوامع و گسترش ارتباطات و تنوع سليقه ها، گاهي شاهد اقشاري از مردم هستيم كه با دلائل مختلف تمايل به رعايت شئونات فرهنگي و عرفي و اعتقادي جامعه خود ندارند اين عدم رعايت گاه در پوشش افراد متبلور است، اگر چه در حقيقت افراد در اعمال سليقه هاي خود آزاد هستند و اين حق از جمله حقوق اساسي شناخته شده براي آنهاست اما اين آزادي بي حد و حصر نبوده و اين اعمال سليقه ها نبايد با فرهنگ هاي مورد احترام مردم جامعه در تعارض باشد. مردمي كه با رأي خويش در جامعه اي دموكراتيك نمايندگان را به مسند قانونگذاري نهاده اند، براي بايد ها و نبايدهاي قانونگذار احترام و اهميت قائلند و آن را مظهر خواست خود مي دانند لذا قانونگذار با وضع مقرراتي به تدوين انديشه ها و آرمان ها جامعه و اعلام آن به افراد مي پردازد. اما آيا اين وضع مقررات در طي اعصار گذشته و حال همواره به درستي و موافق با فرهنگ و اراده ملت صورت مي پذيرد؟ اين تحقيق در بردارنده گفتمان قانونگذار ايران در خصوص پوشش مردم و بيانگر مباني جرم انگاري بدحجابي به عنوان پوششي ناهنجار در جامعه ايراني– باستاني و ايراني - اسلامي است جامعه اي كه آميخته با فرهنگي غني و ديني متعالي است. در همين راستا كليات و مباني دخالت حكومت در نحوه پوشش مردم مورد بررسي قرار گرفته و در ادامه نيز به مباني جرم انگاري پوشش در نظام كيفري ايران مي پردازيم.
