A Reappraisal of Immediacy or lack of Immediacy of GHABN’s Option based on the view of Sheikh Ansari

خيارات از موارد انحلال ارادي معاملات محسوب ميشوند و خيار غبن نيز يكي از انواع اين خيارات است. از جهت مهلت اجرا، خيارات به سه دسته تقسيم مي­شوند؛ خيارات فوري، خياراتي كه مهلت اجراي آن معين است و خياراتي كه ممكن است با تأخير اعمال شوند. بر اساس اين تقسيم، مشهور است كه خيار غبن جزو خيارات فوري است. در فقه اماميه، قول مشهور، فوري‌بودن خيار غبن است و مهم­ترين دليلي كه موافقان فوريت خيار غبن ذكر كرده ­اند اصل فساد فسخ و استصحاب ملكيت است. از طرف ديگر برخي فقها نيز عدم فوريت خيار غبن را برگزيده­اند و معروف­ترين دليلي كه براي عدم فوريت خيار غبن ذكر شده است استصحاب وجود حق فسخ پس از زوال فوريت و شك در وجود يا عدم وجود خيار است. اكنون بايد ديد دلايل كدام گروه قويتر و با نيازهاي معاملاتي امروز همخواني بيشتري دارد. جهت نيل به اين هدف، ديدگاه فقهاي اماميه و حقوق‌دانان را مورد بررسي قرار خواهيم داد و در نتيجه راه حلي جهت اصلاح قوانين ارائه خواهد شد.

Options of rescission is considered to be a deliberate liquidation of contracts and The GHABN’s option is also one of these types of Options. Considering the provision of Article 420 of the Iranian Civil Code on the immediacy of GHABN’s option, there is no doubt that the GHABN’s option will be immediate in law. Nevertheless, in Shiite jurisprudence, however, among the jurists, the Viewpoint of the immediacy of GHABN’s option is popular and some reasons have been given for it, but on the other hand some jurists have also chosen theViewpoin of lack of immediacy of GHABN’s option and have mentioned for that reason. The most important reason for the immediacy of the GHABN’s option is that the principle of FESADE FASKH and ESTESHAB. On the other hand, the most famous reason for the lack of immediacy of GHABN’s option is the principle of ESTESHAB and doubt in the Existence or absence of GHABN’s option
