الزامات حقوقي اقتصاد مقاومتي در«مرحلة قانونگذاري» با تأكيد بر اصل 44 قانون اساسي

Legal Requirements of the Resistive Economy in the "Legislative Phase" with the emphasis on Principle 44 of the Constitution

اقتصاد مقاومتي به‌عنوان راهبردي بنيادي در جهت تغيير ريلگذاري حركت اقتصادي كشور توسط رهبر معظم انقلاب ابلاغ شده است. اعمال تحريم‌هاي ظالمانۀ يكجانبۀ غيرقانوني نظام سلطه به‌منظور وارد آوردن فشار به انقلاب اسلامي كه محدوديت‌هايي براي توسعۀ اقتصادي كشور ايجاد كرده است، از يك‌سو و لزوم به‌هم‌پيوستگي و رابطۀ سياست‌هاي كلي اقتصاد مقاومتي با حوزه‌هاي تخصصي حقوق عمومي در راستاي تحقق رشد و عدالت اجتماعي و اقتصادي، ايجاد رفاه و پويايي مبتني بر توليد و اشتغال و اتكاي ملي از سوي ديگر، ضرورت بررسي الزامات حقوقي اقتصاد مقاومتي را مبرهن مي‌نمايد. سؤال تحقيق اين است كه الزامات حقوقي اقتصاد مقاومتي در مرحلة قانونگذاري با تأكيد بر اصل44 قانون اساسي چيست؟ در پاسخ به اين پرسش، يافتۀ تحقيق كه به‌صورت توصيفي-تحليلي انجام گرفته، بيانگر آن است كه الزامات حقوقي اقتصاد مقاومتي در مرحلة قانونگذاري، تصويب قوانين مؤثر، شفاف، منسجم و منقح است كه كارامدي لازم را به‌منظور عدم اجراي سليقه‌اي قوانين و نيز بستن منافذ رانت و فساد و تبعيض داشته باشد و با فرهنگ‌سازي در سطوح عمومي از يك طرف و استفاده از تجربيات موفق دنيا و بومي‌سازي آنها در كنار عزم ملي بين مسئولان و مردم از طرف ديگر بتواند به‌عنوان راهكاري مهم براي اجراي اقتصاد مقاومتي با رويكرد الزامات حقوقي به‌كار گرفته شود.

The resistive economy has been noticed as a fundamental strategy to change the economy movement of the country by the Supreme Leader of the Revolution. Imposing unlawful unilateral sanctions in order to put pressure on the Islamic Revolution which has imposed restrictions on the country's economic development, on the one hand, and the necessity to integrate and relationship between the general policies of the resistive economy and the specialized areas of public law in order to achieve social and economic growth and justice, welfare and dynamism based on production and employment on the other hand, clarify the necessity of investigating the legal requirements of the resistive economy. The research question is that what are the legal requirements of the legislative phase of resistive economy? In answer to this question, the research findings, which have been done in a descriptive-analytical manner, indicate that the legal requirements of the resistive economy in the legislative phase are the adoption of effective, transparent, coherent and revised laws that make the necessary efficiency in order to enable the creation of public relations between the authorities and the public as a key solution for the implementation of a resistive economy and legal requirements.
