چكيده فارسي :
محل تجلي عدالت و آخرين ملجاء و پناهگاه مردم هر جامعه، تشكيلات قضائي آن كشور است. در مجادلات و مخاصمات، تصميم محكمه، فصل الخطاب بوده و تحقق عدالت و تضمين امنيت و گسترش عدل و آزادي هاي مشروع، منوط به عملكرد قوه قضائيه است. با توجه به تمايلات شهروندان، جهت تحقق و تضمين حقوق و آزادي هاي فردي ، ميزان انتظارات در برخورداري از اين حقوق، رو به تزايد است. شهروندان دست يابي به حقوق شهروندي، جلوگيري از سوء رفتار، شكنجه، بازداشت، توقيف و ضبط اموال و تصرف بيجا در اموال، مشاركت در تصميم گيري ها و تصميم سازي ها، برقراري عدالت، رعايت كرامت انساني و مصاديقي از اين دست را، حقوق بديهي خود مي دانند و در مقابل، زمامداران نيز با تكليف تامين اين حقوق مواجه هستند. با توجه به انتظارات موجود، قوه قضاييه با تكاليف مضاعف تري مواجه است كه به لحاظ جديد بودن برخي از مفاهيم و مصاديق حقوق و آزادي هاي فردي و همچنين مغفول ماندن مسئوليت ساير قوا در محقق شدن اين حقوق، فقد قانون جامع و شفاف، ضعف ضمانت اجرا، ابهام در حدود و قلمرو آزادي و ناسازگاري برخي از مصاديق آن در نظام حقوقي اسلام با نظام حقوقي غرب، ابهام در حدود وظائف دستگاه ها و نهادهاي ذيربط در احياء حقوق و آزادي هاي فردي، عدم هماهنگي و مشاركت ساير قوا و عدم تبيين و توزيع مسئوليت ها در اين حوزه، موانع متعددي را بوجود آورده است.

The manifestation of justice and the last refuge of the people of any society is the judiciary of that country. In disputes, the court's decision is the final opinion, and the realization of justice and the guarantee of security and the expansion of justice and legitimate freedoms depend on the performance of the judiciary.. According to the desires of citizens, in order to realize and guarantee individual rights and freedoms, the level of expectations in enjoying these rights is increasing. Citizens' access to civil rights, prevention of immoral behavior, torture, detention, seizure and confiscation of property, participation in decisions and decision-making, justice, respect for human dignity and similar examples are obvious rights. and in opposite, the rulers are obliged to provide these rights. Given the current expectations, the judiciary faces more responsibilitiesDue to the novelty of some concepts and examples of individual rights and freedoms, as well as neglecting the responsibility of other powers in the realization of these rights, lack of comprehensive and transparent law, weak enforcement guarantees, ambiguity in the realm of freedom and incompatibility of some concepts in the Islamic legal system. With the Western legal system, ambiguity within the duties of the relevant agencies and institutions in the restoration of individual rights and freedoms, lack of coordination and participation of other forces and lack of explanation and distribution of responsibilities in this area, has created several obstacles.
