Environmental Crimes Related to Covid 19: Facets and Flaws

ويروس كوويدـ19 كه از خانواده كروناويروس‌ها مي‌باشد به نحوي موجب تعطيلي مشاغل و توقف فعاليت‌هاي انساني شده كه حتي جنگ‌ها نيز قادر به چنين كاري نيستند. با وجود بيش از چند ميليون مبتلا و كشته در سراسر جهان، اما اين ويروس پيامدهاي مثبتي در حوزه‌هاي مختلفي چون كاهش مصرف انرژي، گازهاي گلخانه‌اي و آلودگي هوا براي محيط‌زيست به همراه داشته است. با وجود اين، فزوني مصرف آب و غذا از جمله پيامدهاي منفي كوويدـ19 براي محيط‌زيست بوده است. در كنار اين پيامدها، اين پرسش مطرح مي‌شود كه در پرتو بيماري كوويدـ19 چه جرايمي عليه محيط‌زيست ارتكاب يافته يا قابليت ارتكاب را دارند. در اين خصوص مي‌توان در حقوق كيفري ايران سه حوزه از محيط‌زيست را شناسايي كرد كه در دوران همه‌گيري ويروس كوويدـ19 جرايمي مرتبط با آن‌ها رخ داده‌ يا قابليت رخ دادن را دارند، كه عبارتند از پسماندهاي پزشكي ويژه، انتقال ويروس كوويدـ19 به گونه‌هاي جانوري و تهديد عليه بهداشت عمومي. با وجود اين نظام حقوقي ايران به طور عام و حقوق كيفري ايران به طور خاص با كاستي‌هايي چون نبودِ ظرفيت قانوني مديريت بحران‌هاي مرتبط با بهداشت عمومي و جامع نبودن جرم‌انگاري حمايت‌مدار از گونه‌هاي جانوري مواجه است كه بايسته است آن‌ها را اصلاح نمايد.

Covid 19 which is a member of the big family of corona viruses, has caused a widespread lock down of businesses and blockage of human activities which is unprecedented and even world wars were not able to do so. Despite the infection of more than four million people around the world and hundreds of thousands of deaths following this worldwide pandemic, there were also some positive effects for this disease in different areas such as decline in the consumption of energy, greenhouse gases and environmental damages and pollution around the world. Although there were negative effects for covid 19 like the increase of food consumption during quarantines caused by it and increase of water consumption because of hygienic purposes. Besides these consequences, there is a question about the criminal aspects of covid 19. In this respects we can mention three different topics in relation to Iranian criminal and environmental law, including the crimes related to special medical waste, transfering the virus to the animals and threatening the public hygiene.
