چكيده فارسي :
تمركز بر شيوه‌هاي بهبود نظام قانون‌گذاري، مسئله مورد بحث و بررسي صاحب‌نظران از گذشته تا كنون بوده است، زيرا كه قانون‌گذاري نيز مانند ديگر رويه‌ها و فرايندهاي جامعه، نيازمند ارتقاء و بهبود مستمر است. بر اين مبنا تحليل روندها و رويه‌هاي هر نظام قانون‌گذاري، يكي از اولويت‌هاي اصلي براي بهبود هر نظام قانون‌گذاري است. از طرف ديگر، براي درك ماهيت‌هاي آسيب‌زاي هر نظام قانون‌گذاري نيز بايد چارچوبي از يك نظام ايدئال را در پيش رو داشت، لذا مقاله حاضر باهدف مطالعه تطبيقي ماهيت و آثار فرايند قانون‌گذاري در ايران و فرانسه به بررسي و تطبيق نهادهاي قانون‌گذار، فرآيند و آثار قانون‌گذار در اين دو كشور به صورت توصيفي-تحليلي پرداخته است. در اين مقاله، اهداف پژوهش در دو بخش مورد بررسي قرار گرفته است. در بخش اول به بررسي و تطبيق نهادهاي قانون‌گذار در دو نظام حقوقي ايران و فرانسه پرداخته است و در بخش بعدي محدوده‌ي قانون‌گذاري در حقوق ايران و فرانسه را مورد بررسي قرار داده است. و در آخر نگارنده به بحث و نتيجه گيري نهايي پيرامون موضوع پژوهش پرداخته است.
چكيده لاتين :
Focusing on the methods of improving the legislation system has been discussed by experts since the past until now, as legislation because legislation like other processes in society requires a continuous promotion and improvement. Accordingly, analyzing the processes of any legislation system is one of the main priorities of improving such a system. On the other hand, a framework of an ideal system should be considered for understanding the traumatic natures of any legislation system. Therefore, the present study aimed at a comparing the nature and effects of legislation process in Iran and France. This study investigated and compared the legislative entities as well as the effects and process of legislation in these two countries using a descriptive-analytical method. In this study, the objectives the were discussed in two parts. The first part examined and compared the legislative entities in two legal systems of Iran and France and the next part examined the scope of legislation in the Iranian and French law. Finally, the researcher made the last discussion and conclusion on the research subject
