The position of education and health of reason in Islamic sources and its role in crime prevention

مينه يكي از چالش هاي نظام هاي حقوقي در مقوله پيشگيري از وقوع جرم، كم توجهي به سلامت و تربيت عقلاني در افراد بزهكار است كه با بهره گيري از تدابير تربيتي موجود در منظومه فكري اسلام مي توان در مواجهه با اين چالش، گام هاي موثري برداشت با عنايت به اين كه منابع اسلامي (فقه شيعه)، از جمله قرآن كريم و روايات معصومين حاوي دستورات بنيادي در موضوع جرم شناختي و پيشگيري از وقوع آن مي باشد؛ هدف از نگارش اين مقاله، تبيين الگوي تربيت عقلاني مطابق با منابع شرعي در زمينه پيشگيري از جرم و اصلاح رويكرد رفتاري جامعه و بررسي نقش آن در فرايند پيشگيري از وقوع جرم و تحقق امنيت مي باشد. روش اين پژوهش از نظر هدف، كاربردي و از نظر روش، پيمايشي است. ابزار گردآوري اطلاعات، كتابخانه اي و ميداني از طريق پرسشنامه محقق ساخته مي باشد كه روايي آن از سوي خبرگان و با در نظر گرفتن بار عاملي سوالات و پايايي آن از طريق آزمون آلفا كرونباخ تاييد شد. جامعه آماري پژوهش حاضر، شامل كليه افرادي (316 نفر) است كه در بازه زماني سه ماه چهارم 1397، از طريق مراجع كيفري در شهرستان شهركرد مجرم شناخته شده كه به روش سرشماري مورد بررسي قرار گرفته اند. براي تجزيه و تحليل داده ها از آزمون هاي رگرسيون گام به گام، آزمون همبستگي پيرسون و آزمون فريدمن استفاده گرديد كه به اين منظور نرم افزار spss به كارگيري شد.

Background One of the challenges of legal systems in the field of crime prevention is the lack of attention to health and intellectual education of criminals. Considering that Islamic sources (Shiite jurisprudence), including the Holy Quran and the narrations of the Infallibles, contain basic instructions on the subject of criminology and the prevention of its occurrence; The purpose of writing this article is to explain the pattern of rational education in accordance with religious sources in the field of crime prevention and reform of society's behavioral approach and to examine its role in the process of crime prevention and security. Method This research is applied in terms of purpose and survey in terms of method. The data collection tool is library and field through a researcher-made questionnaire, the validity of which was confirmed by experts, taking into account the factor load of questions and its reliability through Cronbach's alpha test. The statistical population of the present study includes all individuals (316 people) who have been convicted through criminal authorities in Shahrekord city during the fourth quarter of 1397, which have been examined by census method. Stepwise regression tests, Pearson correlation test and Friedman test were used to analyze the data. For this purpose, SPSS software was used. Results The results of data analysis showed that the educational process, in order of importance, through the components of thinking about criminal action, contemplation and deliberation, consulting and benefiting from the experiences of others and socializing and learning from the wise.
