يكي از محورهاي توسعه بيع، ناظر به قلمرو مبيع از اموال مادي به اموال غير مادي است. كنوانسيون بيع بين الملل كالا تعريفي از"بيع" ارائه نداده و بر اساس مقررات قانون متحد الشكل تجاري امريكا، عقد بيع، عقدي تمليكي بوده و خريدار در ازاي پرداخت ثمن، مالك كالا مي شود. روش تحقيق تحليلي - توصيفي است و سوال اين است، آيا توسعه قلمرو مبيع از اموال مادي به اموال غير مادي، با نظام حقوقي كشور ما تعارض دارد؟ به نظرمي رسد توسعه مفهوم بيع با گسترش قلمرو مبيع از اموال مادي به اموال غير مادي، بدون اينكه با نظام حقوقي كشور ما تعارض داشته باشد، قابل توجيه بوده و از لحاظ مفهوم تفاوت دارد در نتيجه از لحاظ تعارض و مفهوم كه تفاوت دارد قابل توجه است.

The method of research is analytical-descriptive and the question is whether the development of the territory of the seller from tangible to the intangible property conflicts with the legal system of our country or the concept of sale is different in the International Convention on American Commercial Code? The hypothesis seems that the development of the concept of sale by expanding the territory of the seller from tangible to intangible property, without conflicting with the legal system of our country, is justifiable.
