چكيده فارسي :
در قوانين و گزارش هاي كارشناسي رسمي در سه دهه گذشته همواره بر تسريع خصوصي سازي تاكيد شده است. اين در حالي است كه بعد از سپري شدن هر دوره از خصوصي سازي، همگان درباره اشتباه ها يا كج روي هاي آن در دوره قبل صحبت كرده اند. در واقع در هر برهه اذعان شده است كه خصوصي سازي هاي گذشته صحيح نبوده است و هم زمان گمان برده شده است كه آينده خصوصي سازي براي اقتصاد كشور نويدبخش خواهد بود. در اين مقاله با مطالعه گزارش هاي كارشناسي رسمي، مسير طي شده خصوصي سازي ها را ارزيابي مي كنيم و در توضيح اين مسير، در مقابل رويكردي كه اصلاح خصوصي سازي را از طريق راه حل هاي حقوقي و ديوان سالارانه پيگيري كرده است، استدلال مي كنيم كه قوانين توضيح دهنده و تعيين كننده مسير خصوصي سازي نيستند، زيرا خود نيازمند توضيح اند و توازن نيروهاست كه قوانين را توضيح مي دهد. عملكرد ديوان سالاري را نيز بدون توازن نيروها نمي توان توضيح داد. بر اين اساس، اين فرضيه را مطرح مي كنيم كه ايرادهاي مشاهده شده خصوصي سازي ناشي خطاهاي انساني يا سازماني يا برخي اعراض خصوصي سازي اجراشده نيست، بلكه ناشي از اصل خصوصي سازي است. بر اين اساس، در پايان با توجه به مشكلات خصوصي سازي ها و با ارجاع به اصل 44 قانون اساسي كه بخش تعاوني را هم عرض دو بخش دولتي و خصوصي قرار داده است، پيشنهاد مي شود «تعاوني سازي» به مثابه مسير بديل واگذاري ها بنگاه هاي دولتي به رسميت شناخته شود.

The facilitation of privatization has always been emphasized in laws and official expert reports over the last three decades. However, after each privatization period, everyone keeps talking about its mistakes or deviations in the previous period. In fact, it has always been acknowledged that past privatizations have not been principled, and it has always been speculated that the future of privatization will be promising for the economy of the country. In the present study, using the official expert reports, the progress of privatization is evaluated and while explaining this process, regarding the approaches that pursue privatization reforms through legal and bureaucratic solutions, it is argued that laws do not explain and determine the process of privatization, because they, in turn, need to be explained, and it is the balance of power that explains the laws. The function of bureaucracy cannot also be explained without the balance of power. Accordingly, it is hypothesized that the observed flaws in privatization are not the result of human or organizational errors, or some of the flaws carried out in the privatization, but of the nature of privatization itself. Accordingly, in the end, given the problems of privatization and referring to Article 44 of the Constitution, which considers the cooperative sector as important as public and private sectors, " cooperativization " is recommended to be recognized as an alternative for the transfer of state-owned enterprises.
